Although I know that Mr.Burd is upset that the non-compete clause will be enforced because
he wants to move to be with his mother, I would seek to expand information on how he is feeling
and use empathy and understanding in hopes of allowing him to explain everything and that
would make him calm down by talking it out. I would also like to probe the McConnell president
for exactly why he wants to enforce the non-compete rather than the monetary penalty and how
that would affect future relations with possible hires. Lastly, I will try to open their eyes to the
consequences of not settling the issue, whether it be harm to reputation or a significant monetary
loss.

Increased empathy and understanding
a.
“Help me understand: Why is it very important that the non-compete clause be
enforced?”
i.
I would hope to have the president maybe tell me of past issues that he has had
when the non-compete clause hadn’t been enforced and how that has affected
him.
ii.
I would seek this in a joint session because this is the main issue that is being
faced and it is important for Mr.Burd to know exactly why McConnell is
pushing for the non-compete to be enforced.
b.
“I understand that you had a strong reaction when you learned that the non-compete
clause would be enforced. Would you like to talk about that?”
i.
I would hope to have Mr.Burd to further explain the hurt he is facing by not
being able to move to take care of his mom given that he will not be able to
work in that area.
ii.
I would seek this in a joint session because maybe the president hearing how
important this is to him and expand on why he feels like he has to move to take
care of his mom would make him more empathetic to the situation and see it
from Mr.Burd’s point of view, causing him to compromise on the non-compete
clause.
2.
More issues, people, resources
a.
“Was your decision to enforce the non-compete clause rather than the monetary
penalty intended to anger Mr.Burd?”
i.
I would hope to have the president confirm that it was not his intent to anger or
offend Mr.Burd with his decision so that it is easier to reach a compromise. He
could respond by saying that although both options were in the contract the
standard practice is to enforce the non-compete. Maybe this can also get the
president to consider offering the monetary penalty instead of the non-compete
clause.
ii.
I would seek this information in a joint session because the facts stated Mr.Burd
felt that they were callous and he was angered so knowing the reason why the
non-compete option was chosen. This is especially important if the president
states that it is common practice.
b.
“Mr.Burd, would your mother be willing to move here so that you can stay at the
firm and the non-compete clause would not be necessary?”
i.
I would hope for Mr.Burd to respond that she possibly would or at least keep
that in mind even if the issue is not resolved today. It would be great to know if
Mr.Burd and his mother discussed it before.
ii.
I would seek this information in a private caucus because if Mr.Burd confirms
that she is willing to or they have already discussed it that the McConnell
president would not be willing to negotiate about the issue at all. Knowing this
information can help me go back into the joint session and aid more in
negotiations.
