My Position : o I Alex have a registered account with Taylor’s company. o The terms and conditions limit damages for lost or damaged goods to a maximum of $250 o My personal items are valued at around $4,000 for me even though I probably overestimated that price, although proving this value might be difficult considering I don’t have any receipts for the value of the clothes and they are all old clothes. Taylor’s Perspective : o Taylor likely wants to retain me as a customer for future business and avoid negative reviews online. Also getting sued by me even though he believe he would have a good case against damages because of the terms and conditions. o He may be constrained by the company’s policies and financial limits to offer me more just compensation so other things need to be negotiated. 2. Your Goals : o Recover the maximum compensation possible for my lost items, either monetarily or other means o Find a resolution that acknowledges that you are being compensated for the loss of significant items. 3. Negotiation Strategies : o Empathy : Begin the conversation empathetically. Acknowledge Taylor’s position as the owner of the business and the company’s overall policy. o Highlight Sentimental Value : Try to use emotional appeal from Taylor as I explain the emotional significance of the items. Explain that as a long time consumer of the service I know and have trusted you to be a fair person, and during this difficult time I would really appreciate some kind of just compensation for this significant loss. o Creative Solutions : Suggest alternative compensation beyond monetary value (e.g., credit for future services that will be in addition to the initial $250 you are entitled to maybe up to another few hundred dollars While the policy does only allow for $250 and since they are the owner of the business I could ask that under the circumstances and considering I have been a loyal customer to them since the beginning of the business, I could possible find a way to get a higher reimbursement that will not financial burden the company Offer to help implement a system that will help keep track of packages that they tack care of, whether it is digital or etc., and negotiate that I get partial
commission/revenue over the next few months with the company to make up for my lost items. Assurance that they will continue to look for the lost items by contacting customers and improving their tracking and driver training. Propose a compromise amount that considers both the policy limit and your emotional attachment. o Leverage Your Influence : Remind Taylor of your intention to leave negative reviews if fair terms are not met in regard to your goals. I wouldn’t want to burden the business with bad public representation but feel it would be fair. Be respectful but firm.
