Legal Cases There have been many legal cases that have played roles in laws and policies governing language instruction within school systems. Lau v. Nichols, Castaneda v. Pickard, Flores v. Arizona, and Plyler v. Doe policies have enabled teachers over time to understand the necessity for English language learners. Each of these cases involved a group or groups of people who claimed their civil rights were affected and violated. They felt they were not being treated fairly under the country’s constitution. Each case determined the defendant were mistreated based on their culture and acts were put into place to better serve the students and the people of this nation. Plyler vs. Doe found that it is wrong to deny children education whether they are legally is the U.S. or not. Flores v. Arizona found that limited English-speaking students at a school were not receiving the correct program for instruction or adequate funding for their education. This created programs and funding for ELL students. Castaneda v. Pickard helped develop three criteria that grouping and educational practices need to be based on sound educational theory, implemented effectively and must be trial period overcoming language handicaps. Lou v. Nichols was another case where ELL and bilingual students were not provided adequate modifications and education which resulted in further research and support in this area. Federal Law There have been several federal laws put in place to give English Language Learners the opportunity and healthy school environment they deserve. They had effect on accountability, assessments, funding, and identification of ELL education. Every Student Succeeds Act (ESSA) was implemented to ensure our nations education law and commitment to equal opportunity for all students. Through Title III and Title IV of the Student Support and Academic Enrichment the federal government pushes equal opportunity. They do this by improving students’ academic achievement by increasing the states capacity, local educational agencies, and providing all students with well-rounded education. The goal is to improve the school conditions for learning and improve use of technology. (Arizona Department of Education, 2022) State Laws State law and policies promoted language acquisition methodology, student grouping, and the time frame to achieve language proficiency through Proposition 203, House Bill 2064, SB 2064, and move on when Reading bills. These bills were established to provide ELL students earlier help in their academic plan. They are making sure to maximize time early for students to have success in their education and reach their full potential. These State Laws and Bills help provide time and more funding to educational departments to subgroup and personalize opportunities for ELL students. (Arizona Department of Education, 2022) Current Trends In relation to ELL students and current trends my question is how do you make sure students are getting what they need while also making sure they are learning on their grade level for standardized testing? One trend in today’s education is standardized testing to make sure students on level. It can be hard for teaches to make students are getting all the modifications they need by making sure they are learning the curriculum. Learning a new language and cultural diversity can be tough enough to learn adding standardized testing on top of that can be tough. Another trend that can be an issue is teachers feeling pressured to have their students pass
