Dr. Berne’s Contaminated Eyedrops The company Dr. Berne’s Whole Health Products had two cases of eye infections reported after the consumer used their Dr. Berne’s MSM Drops 5% Solution. The company failed a sterility sampling evaluation/testing on one lot of Dr. Berne’s products. This type of failure according to the FDA “can result in minor to serious vision-threatening infections that could potential lead to a fatal infection.” (FDA 2023) As a result of the quality dimension conformance failure, Dr. Berne’s Whole Health Products chose to initiate a voluntary recall on all of their products including their MSM drops at 5 and 15% Solution, Dr. Berne’s Organic Castor Oil Eye Drops and Dr. Berne’s MSM mist 15% Solution “out of an abundance of caution.” (Katherine Dillinger 2023) The company started notifying its customers and distributors via email to arrange for the potentially contaminated products to be returned. As a corrective action, full refunds were offered as well as replacements if wanted from products that had been tested negative for microbial growth by a 3 rd party testing facility. The unfortunate events of this failure and recall were unrecoverable to the company and forced Dr. Berne’s company to permanently close their webstore and discontinue production and sale of all of their products. As a result, this will impact all of Dr. Berne’s distributors and suppliers. Zhaoqing Juhong Co., Ltd (Zhaoquing)’s Defective Tires Poor quality performance, conformance, reliability and durability lead to a potential highway safety concern. Zhaoquing, the manufacturer of tires had an FMVSS (Federal Motor Vehicle Safety Standard) failure on their Antares Comfort A5 tires. Anyone that has purchased these tires (within a certain manufacturing date range) for their light vehicle is risking the belt separating from the tire which can lead to “loss of vehicle control with the increased risk of a crash.” (NHTSA 2022) Zhaoqing decided to initiate a recall on over 3,000 of their specific Antares comfort tires to contain the issue. They have contacted owners and dealers of the recall. Dealers are set up to inspect the tires for the specific manufacturing dates of the suspect tires. If tires are found with the suspect date, then the tires will be replaced. (Vehicletire 2024)
The safety failure of these tires impacted not only the consumer, but the dealers, suppliers and distribution networks that handle and sale these tires. Even though the company is still in business and selling their products, this recall will forever impact the company’s perceived quality and will always have a “red X” on their report card due to this incident. Oreck Discover Upright Vacuum Electrical Shock Hazard Oreck’s failure to meet the quality dimensions of performance, conformance, and durability put many consumers at risk of electrical shock. The vacuum’s electrical plug contains a high risk quality defect which has been reported by 41 consumers. The vacuum’s plug prong is reported to “detach and remain in an electrical outlet when the vacuum is unplugged leading to the potential risk of electrical shock.” (U.S. Consumer Product Safety Commission 2023) Oreck decided to recall 6200 units for this potential failure. They have ordered all consumers to immediately stop using the product and contact their nearest service center or Oreck dealer. To correct the issue the, the Oreck dealer will repair the vacuum by replacing the suspect electrical plug. (Oreck 2023) Oreck is suffering from this and many other recalls on their products. Their perceived quality is poor and there is a recall lawsuit currently in action for this specific recall by Johnson/Becker PLLC. This negative press and poor perceived quality has impacted the company, their employees, and distribution centers with a reduction in the number of people purchasing these vacuums. This is good news for their competitors though who are reaping the benefits of Oreck’s loss. All three of these companies put their customers at risk of some type of injury whether it was infection, potential vehicle crash, or electrical shock. They all acted and issued a recall on their defective product and remedied their failures by offering refunds, replacements or repairs. Two of the three companies were able to recover from these tragedies, Dr. Berne’s unfortunately was not able to.
