The most important legal and regulatory factors, that must be discussed in the meeting are health
Insurance Portability and Accountability Act (HIPAA) and Doctor/Patient Confidentiality. HIPPA was
created to protect everyone’s healthcare records and keep their privacy. Whatever personal concern or
matter you may experience and may need any treatment for, it is illegal for that information to leave the
physician's office and the company can be penalized have it happen. The department of health and
human services created 5 rules to enforce Administrative Simplification: (1) Privacy Rule, (2) Transactions
and Code Sets Rule, (3) Security Rule, (4) Unique Identifiers Rule, and (5) Enforcement Rule. "The Privacy
Rule requires covered entities to notify individuals of PHI use, keep track of disclosures, and document
privacy policies and procedures (Edemekong, 2022)."
Technology has created a greater impact on providers keeping their patient's information safe knowing
now that everything is documented onto a computer. There are things that are supposed to be left
confidential, as well as things that a doctor may know but just kept private. “The standard of care is the
benchmark that determines whether professional obligations to patients have been met. Failure to meet
the standard of care is negligence, which can carry significant consequences for clinicians (Vanderpool,
2021).” Ethical issues arise in the use of information technology which are why there are principles of
privacy, the patient’s right to autonomy and decision making in the management of their personal health
information, and concepts of fairness and equity in access to care the most important thing is the
confidentiality of the patient regardless of changes.
