Jurisdictional Issues
Believes that local authorities should not send local tax dollars to help the federal government to enforce federal law (Sanctuary Cities and the Rule of Law 2017) However, the basics of immigration law and policy should be understood by the authority.
Courts in these cities make a decision over undocumented Immigrant policies, ensure that those affected are never jailed for long periods of time for nonviolent crimes.
Describe how the U.S. law enforcement and court systems function together
.
The U.S. Law enforcement agencies and court systems work together to enforce the laws and policies enacted by their governments,
With the goal of preventing infractions of those laws and policies. Law enforcement agencies patrol their assigned
regions to establish a visible presence In an effort to discourage crime while holding those who break the law accountable.
The job of the judicial system is to interpret the law that has been broken and to impose a fair and just sentence in accordance with the law.
Include at least one dysfunction or challenge area.
When law enforcement agencies do not follow correct regulations and procedures, it is one of the most difficult areas of the legal system to deal with. This could be due to a number of reasons including, absence of evidence, evidence collected illegally, and faulty arrest methods. Thankfully there are advocates who create organizations such as the Innocence Project. A group that works to free the innocent, prevent wrongful conviction, and create fair and compassionate systems of justice for everyone.
Follow-Up Questions
Answer the questions below in two to five sentences in order to elaborate on the process represented in the graphic organizer above. Use examples from the article provided in the Module Four Assignment Guidelines and Rubric to support your responses.
1.
Identify the functions of law enforcement related to sanctuary cities in the resources provided. What is law enforcement allowed to do, according to Senate Bill 4? What impact or lack thereof has the law had on police operations? Law enforcement officials associated with sanctuary cities apprehend those who are in the country illegally and challenge the immigration status of those they arrest or detain incorporating those in routine traffic stops Such as in cities in Texas, according to Senate Bill 4. In sanctuary cities, law enforcement is not required to report undocumented immigrants to Ice. However, under Senate Bill 4. Texas law enforcement is allowed to question the
immigration status of anyone they arrest or detain, including during regular traffic stops (Fernandez, 2018). Senate Bill 4 states that officers don't have to
ask about a person's immigration status but instead permit them to ask at that officer’s choice. Senate Bill allows for police to ask about the immigration status of a person under lawful detention or under arrest. According to Senate Bill 4, which bans sanctuary cities, law enforcement is allowed to question
anyone they arrest on their immigration and citizenship status. They do not need to do this to everyone, though they have the power to, it is up to the officer’s discretion.
2.
Identify the functions of court systems related to sanctuary cities in the resources provided. What did this US Court of Appeals for the Fifth Circuit do? What Constitutional issues may arise? The US Court of Appeals for the Fifth Circuit maintained nearly all the laws of Senate Bill 4. However, it said that local authorities with restricted recourses bringing them incapable to uphold federal immigration enforcement are not breaking the law. They also struck down the part that bars officials from even speaking on policies that can alter immigration enforcement. If that were to pass, that would be an obvious violation of the First Amendment. The Supreme Court has started that immigration enforcement is the duty of the federal government. 3.
Describe how the U.S. law enforcement and court systems relate to sanctuary cities using information from the resources provided. How did they respond to shared issues? What is at least one challenge area for the police in relationship to holding detainees? They believe that immigration enforcement is the primary responsibility of the federal government and diverts resources as well as threatens the relationship between the police and immigrant communities. Therefore, many in law enforcement in relation to sanctuary cities have taken a stance against laws such as the senate Bill 4 in Texas in which they are expected to question a person's immigration status when arrested. The mayor of Houston declared after the law was passed that the "H.P.D. (Houston Police Department) should not function as an arm of ICE" [Fernandez, 2018). In contrast and as stated above, the state courts have responded differently due to the fact that federal law overrides state laws. This means that state-
level courts may be legally obligated to punish officials.
