trying to address. Discuss the many modern day alternatives to incarceration and explain whether
these are a potential solution to the overcrowding problem.

Overcrowding in the prisons have caused many problems in many jurisdictions. Intermediate sanctions are one of the alternatives to prison. There are older methods that we are familiar with but also new advancements in technology that provide an even more effective intermediate sanction. Much like an intermediate sentence, specialized courts are a diversion to prison instead of an alternative to prison. There are many diverse options besides adding to the overgrowing incarcerated population.
Intermediate sanctions are used as an alternative to prison. There are many different methods used instead of being sentenced to prison such as probation, fines, community service and electronic monitoring. Fines can be an effective option, but they are often viewed as unfair to
the poor. “They can also be counterproductive, because if the defendant doesn’t pay (even on a payment plan) the court will issue a failure to pay fines and cost warrant, and the defendant will end up in jail.” (Lecture reading) There are two different kinds of probation, SIS (Suspended Imposition Sentence) and SES (Suspended Execution Sentence). SIS probation is where after completion of the probation and any special requirements are completed then the charges would not be on record anymore. SES probation makes the charge permanent but both types of probation can come with jail time with it. “Electronic monitoring is one of the newer intermediate sanctions, and it’s being used more frequently, in particular because it can be used in conjunction with house arrest.” (Lecture Reading) A benefit of electronic monitoring is that the computer analyzes most of the activity and alerting officials if the person goes outside the area of which they are mandated to stay. House arrest is usually incorporated with electronic monitoring as well. The offender avoids jail to stay home. As easy as it sounds to have electronic monitoring or house arrest or even both, 2
