1. List all protected classes listed in the statute and that are covered by Title IV. I couldn’t find protected classes under title IV in the book, so I am presuming you meant Title VII.
In that case, the protected classes are race, color, national origin, religion, and sex.
2. Summarize each of the following laws
Title IV - Title VII of the Civil Rights Act of 1964 prohibits job discrimination against employees and applicants on the basis of race, color, natural origin, religion, and sex.
Title IX - “No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.”
ADEA - The Age Discrimination in Employment Act (ADEA) of 1967 protects individuals who are 40 years of age or older from employment discrimination based on age.
ADA - The Americans with Disabilities Act (ADA) of 1990 was passed into law to prohibit discrimination against individuals with a disability.
Equal Pay Act - The Equal Pay Act requires that men and women in the same workplace be given
equal pay for equal work.
Pregnancy Discrimination Act - protections fall under Title IX.
3. Define the following terms:
EEOC - is the federal agency that enforces the federal laws prohibiting discrimination and it also provides oversight of all federal and equal employment opportunity regulations, practices, and policies.
Places of Public accommodation - Title III of the ADA requires owners and operators of places of public accommodation to allow disabled individuals to participate equally in the goods, services, and accommodations provided by the establishment.
Disparate compensation - occurs when individuals are compensated differently based on status or membership in a protected class.
Disparate impact discrimination - occurs when a policy that appears to be neutral has a disproportionate impact on one group.
Disparate treatment discrimination - occurs when individuals receive different treatment based on status or membership in a protected class.
4. To prove a prima facie case of disparate treatment discrimination, the plaintiff must show the following:
(1) he or she is a member of a protected class, (2) he or she applied for or was qualified for the position, (3) he or she suffered an adverse employment decision, and (4) the position remained open and the employer continued to seek applicants or he or she was treated less favorably than other similarly situated employees.
5. List the components of the three prong test a school can use to determine if they are in compliance with Title IX. 1. intercollegiate level participation for male and females must be in proportion to their respective enrollment.
2. Institution must show a history and continuing practice of program expansion for underrepresented sex.
3. If institution cannot show continuing practice of expansion, where it can be demonstrated that the interests and abilities of the members of the sex have been fully and effectively accommodated by the present program.
6. List and summarize the criteria required to have a valid, enforceable contract. A contract must contain: (1) agreement between the parties (mutual assent) demonstrated by offer and acceptance of the offer; (2) exchange of consideration between the parties; (3) proper subject matter (legality); and, (4) competence of the parties (capacity).
