Functions and Processes Related to Sanctuary Cities Law Enforcement Courts What They Do “Federal Immigrations and Customs Enforcement (ICE) is responsible for detaining and deporting undocumented immigrants” (PowerD MS, 2020). ICE typically relies on local law enforcement to help find and d etain undocumented immigrants. L ocal law enforcement is not allowed to ask a person if they have paperers or not. “But in many "sanctuary cities”, law enforcement agencie s ignore ICE detainment requests” (PowerDMS, 2020). Senate Bill 4 allows police officers to question immigration status of anyone they arrest. [Insert text.] The role of the court in a sanctuary city is the same as anywhere else. It is up to them and local law enforcement if they want to comply with ICE or not. It is the federal governments job to deport undocumented immigrants. [Insert text.] Jurisdictional Issues ICE does not have jurisdiction in sanctuary cities and need help from the local law enforcement in these places. It is up to local law enforcement to decide if they work with ICE or ingnore their requests. “Federal courts have ruled that complying with these requests is voluntary since th 4 th Amndment prohibits law enforcement agencies from holding someone in jail without a warrant” (PowerDMS, 2020). [Insert text.] Sanctuary cities are constitutional and does not require local law enforcement to help deport undocumented immigrants. The courts still must follow constitutional rights no matter what. [Insert text.] Describe how the U.S. law enforcement and court systems function together . [Insert text.] U.S . law enforcement and court systems function together in various ways. Some of these functins include: “deci ding whether or not to hear a case, shareing intelligence, asking law enforcement officers to testify during a trial, e ngaging in presentencing investigations, and determining alternative sentencing options” ( CriminalJustice, 2019). Include at least one dysfunction or challenge area. One challenge that arises are laws that ban cooperation between local law enforcement and ICE like in Cook County in 2011 ( CNN , 2016). Identify the functions of law enforcement related to sanctuary cities in the resources provided. What is law enforcement allowed to do, according to Senate Bill 4? What impact or lack thereof has the law had on police operations? [Insert text.] According to Senate Bill 4 law eenforcement is allowed to ask for the immigration status of anyone they arrest. “Senat Bill 4, or S.B. 4, does not require all officers to ask about a person’s immigration status, but instead allows them to ask those questions at th officers’ discretion” (Fer nandez, 2018). According to the article by Manny Fernandez, many police officers do not ask detainees about their immigration status because of fear of being accused of racial profiling (2018). 2. Identify the functions of court systems related to sanctuary cities in the resources provided. What did this US Court of Appeals for the Fifth Circuit do? What Constitutional issues may arise? [Insert text.] The US Court of Appeals for the Fifth Circuit allows for almost all the S.B. 4 provisions to be followed . Although, this ruling could narrow th effect of the law according to Fernandez (20 18). “ The Fifth Circuit judges struck down one provision of the law -- a clause that had barred officials even from endorsing policies that limit immigration enforcement, which the judges said violated the First Amendment” (Fernande z, 2018) . 3. Describe how the U.S. law enforcement and course systems relate to sanctuary cities using information from the resources provided. How did they respond to shared issues? What is at least one challenge area for the police in relationship to holding detainees? [Insert text.] Once the S.B. 4 was passed there was concern about whether there would be an issue concerning widespread racial profiling.
