Whalling Law Group, PLLC 3300 West Lakeview Blvd. Office 221B Phoenix, AZ 85017 Memorandum of Law To: Kevin Whalling, Esq. From: Noah Conn Date: 10-29-23 Subject: Professionalization of Court Appointed Special Advocates – Rachel Deckard Case Issue Should Court Appointed Special Advocates (CASAs) undergo professionalization through training and credentials to better serve the interests of children like Rachel Deckard within the judicial system? Facts Trained volunteers known as Court Appointed Special Advocates (CASAs) are chosen by the courts to speak up for the best interests of children involved in the legal system, usually as a result of abuse or neglect. conducting interviews and reviewing documents to obtain thorough information about the child's situation. providing the court with thorough, unbiased reports that include suggestions for what's in the best interests of the child. arguing in favor of prompt court rulings that honor a child's need for stability in their environment and sense of time. ensuring that, while in foster care, the child's needs are satisfied, and their rights are upheld. Until the case is resolved and the child is placed in a secure, long-term home, providing a steady adult presence in the child's life. Discussion Evaluate whether these services are helpful to the court system.] The court system has shown to greatly benefit from the CASAs' services. By making sure that every child's particular circumstances are carefully considered, CASAs not only reduce the workload of the court but also offer vital information that might affect the court's decision-making. CASAs can provide a personalized touch, making sure the child is taken seriously and feels heard. They significantly contribute to accelerating these kids' legal proceedings and minimizing the amount of time they are left in uncertainty by doing this. According to research, kids who have a CASA representation frequently get more assistance and have a higher chance of finding permanent homes than kids who don't (Youngclarke, Ramos, & Granger-Merkle, 2004). Conclusion Considering the crucial function CASAs play in the legal system and the significant influence they can have on a child's life, it is essential to make sure they have the resources, know-how, and abilities needed. Increasing CASAs' professionalism with more training and certifications could improve the caliber of their advocacy even
more. A systematic credentialing procedure, regular examinations, and a defined training program could all be examples of this professionalization. This could guarantee uniformity in the caliber of counsel and raise CASAs' stature in the eyes of the judiciary. For the benefit of children's futures, it is therefore justified to move toward further regulation and professionalization of CASAs, even though there may be implementational difficulties.
