Scenario 2 Heroin User 1. What is the ethical dilemma? ( you can use the principles in Appendix 57 for this answer) Principles 1 The Counseling RelationshipPrinciple Principles 2 Confidentiality and Privileged Communication Principle 7 Confidentiality and Privileged Communication (Perkinson,2021) 2. What are the ethical codes that may apply? (these are the bullet points listed under the principles) Principles 1 The Counseling RelationshipPrinciple I-1 Client Welfare Addiction professionals shall accept their responsibility to ensure the safety and welfare of their client, and shall act for the good of each client while exercising respect, sensitivity, and compassion. Providers shall treat each client with dignity, honor, and respect, and act in the best interest of each client. I-8 Mandated Clients Addiction professionals who work with clients who have been mandated to counseling and related services, shall discuss legal and ethical limitations to confidentiality. Providers shall explain confidentiality, limits to confidentiality, and the sharing of information for supervision and consultation purposes prior to the beginning of the therapeutic or service relationship. If the client refuses services, the provider shall discuss with the client the potential consequences of refusing mandated services, while respecting client's autonomy. Principle 2 Confidentiality and Privileged Communication
II-4 Sharing Addiction professionals shall engage in ongoing discussions with the client regarding how, when, and with whom information is to be shared. II-7 Limits of Confidentiality Addiction professionals, during informed consent, shall disclose the legal and ethical limits of confidentiality and shall disclose the legal exceptions to confidentiality. Confidentiality and limitations to confidentiality shall be reviewed as needed during the counseling relationship. Providers shall review with each client all circumstances where confidential information may be requested, and where disclosure of confidential information may be legally required II-8 Imminent Danger Addiction professionals shall only reveal client identity or confidential information without client consent when a client presents a clear and imminent danger to themselves or to another person, and only to emergency personnel who are directly involved in reducing the danger or threat. Counselors shall obtain supervision or consultation when unsure about the validity of an exception, and shall document the recommendations. Principle 7 Confidentiality and Privileged Communication VII 14 Treatment Educators and site supervisors shall assume the primary obligation of assisting students to acquire ethics, knowledge, and skills necessary to treat substance use and addictive behavioral disorders ( Perkinson, 2021)
3. Are there any applicable laws? (sexual or financial exploitation of a client is against the law; you can breach confidentiality to report if a client is suicidal or homicidal, or you have information about child abuse in any form) Yes, there is with his/her spouse calling saying that they are concerned with the history of several accidental overdoes The law could be informed even if you did not as a counselor didn’t ask about it you have to be aware of the safety of your client. 4. Considering the codes and the laws that are applicable what are possible actions to deal with this dilemma? Since it is a mandated client with the courts, they should be aware of the information that was provided to you with the spouse calling saying he/she was kicked out for using Heiron. Wellness check on the client. 5. What action did you choose and why? I chose to get ahold of the courts because of the information presented that the client had left the session not feeling well because of alleged food poisoning. He/she said she was 3 months sober. The information spouse said that they had kicked them out for using heroin and a history of accidental overdoes. These give concern that they may have used. I would call my clients for a wellness check to see how they are.
