Labor Relations Process
Wanting to sell outside the company’s comfort zone and venture out for globalization, it is typical for car manufacturers to want to build new facilities in other countries outside their homeland. Another benefit of going global is creating an opportunity for the company to develop
alliances and partnerships with other car manufacturers. There are new management and new employees whenever there is a new facility in a new location. Management positions must be filled to manage and oversee operations, and labor positions must be filled quickly so operations can start. To prevent an unwanted hostile work environment, employers and employees will request to bring in a labor lawyer. Depending on state to state, the role of a labor lawyer is to help clients with employment issues concerning the relationship between the employer and the employee or the union representation (University of Washington, 2023). To be efficient in their job, labor lawyers not only need to be familiar with the state laws that apply to where they practice, but they also must be familiar with federal labor laws. Labor Lawyers are responsible for drafting solutions to correct collective actions. In the new facility, corporate management requests that the labor lawyer prepare a position paper regarding the labor relations process at the
new plant. This paper will discuss the following concerns Management would like to address: 1) Should we attempt to avoid unionization as other foreign plants have in the area, though the company's headquarters are in a European Union (EU) country with strict labor laws? If so, what
should be our strategy now and in the future? 2) What should our strategies, tactics, goals, and process be in collective bargaining? 3) Identify the different laws for the United States versus the
EU that might drive the labor relations process; 4) List mandatory and discretionary benefits the company should offer.

Unionization
Most employers want to avoid unionization in their company. Having a union in the company can give the employees an impression that the employers need complete control of their company and can only run it if they see fit. Employers will try their best to persuade employees from forming or seeking unionization through false tactics by bringing in a labor lawyer to help create rumors about the loss of positions within the company (Holley, Ross, & Wolters, 2016). The car manufacturing industry has a high demand for labor and long shift hours. It is typical to see that the pay is barely over the minimum wage. Because of long working
hours and minimum pay, unionization is expected in this industry.
Unionization shouldn’t be avoided even if other foreign plants are in the area. If unionization meets the company's needs and eases employee's concerns, employers should keep an open mind to it. Unionization represents "a fundamental human right" (Silvia, 2018). Unionization aims to improve work environments, advocate for workers' injustice, and help build
a better-quality work life in the company. In 2010, Bob King became the United Auto Workers (UAW)
unionization president, consisting of 386,67 members. Even though the foreign-owned company’s headquarters are in their homeland country with strict labor laws, for the UAW to survive, they must enter the foreign-owned automobile factories (Silvia, 2018). The foreign-
owned company’s plants produced 43.6% of the vehicles made in the United States. The strategy
now and in the future is that the UAW must be fundamentally and innovatively different from the UAW of the past and see each other as partners rather than as opponents (Silvia, 2018).
Collective Bargaining Strategy
The primary focus of unions is collective bargaining, with its main concern being to provide councils and a voice for employees in the workplace (Silvia, 2018). The best strategy for
collective bargaining that managers should take is the integrative bargaining approach.
