Week 11 Reflection
This week’s topics were discussing Employers Liability and Non-Delegable Duty and Vicarious Liability. These topics are very interesting to me as I am currently on WorkCover for a psychological injury I suffered at work and issues such as bullying and stress at other workplaces. Although the law is clear on the fact that employers have a duty of care towards their employees as was demonstrated in the case of Czatyrko v Edith Cowan University
(2005), there are still many grey areas in this area of law especially regarding employees’ mental health issues. A study has found that a whopping 43% of people that are suffering from stress and mental issues claim these are caused by their workplace. This is a concern as this indicates that not enough is being done to tackle these issues and holding employers accountable. It is often also difficult for those that are suffering from issues such as bullying in the workplace to take legal action against their employer as proving these matters in court is often difficult as well as expensive and time consuming. Therefore, I think
that tougher legislation is needed to protect employees and to make employers accountable. Furthermore, the workshops have been really helpful to me as the tutor went through detail
on how to answer hypothetical questions in an exam. I have often struggled with answering hypothetical questions therefore these workshops have been invaluable to me. This week hypotheticals in the workplace were discussed and the case and answer was dissected into sections by the tutor. The elements of negligence were discussed, The Workers Compensation Act 2003, who to sue and the type of injury. These workshops will help me to
complete the exam. Overall, I really enjoyed this week’s content, lectures and workshop.
