Running Head: Assignment 5 Group Assignment 2 Assignment 5(Group Assignment) Components of Fape: FAPE, also known as Free Appropriate Public Education, is a legal concept that mandates that all students with disabilities have access to an education that is tailored to their individual needs and provided at no cost to their families. FAPE guarantees that a child has a right to a free and appropriate public education,regardless of the severity of their disability. Students with disabilities also have legal rights and require schools to provide special education to meet their unique needs. “The law defines a FAPE as special education and related services that (a)are provided at public expense, under public supervision and direction, and without charge,(b)meet the standards of the State educational agency(c)include an appropriate preschool, elementary, or secondary school education in the state involved, an(d) are provided in conformity with the individualized education program. (IDEA, 20 U.S.C. § 1401[a][18])” (Yell, 2018). Special Education Decoded further clarifies that FAPE refers to “all qualified persons with disabilities within the jurisdiction of the school district,” in their informative YouTube video.(FAPE | Free Appropriate Public Education | Special Education Decoded, 2019).The U.S. Department of Education states an appropriate education will include“education services designed to meet the individual education needs of students with and without disabilities. How is FAPE important to you and your future endeavors of being a highly qualified educator for your students. FAPE is incredibly important for myself as a future educator to understand and be able to implement correctly. Unfortunately, "failure to provide people with special needs an appropriate education frequently occurs as a result of misclassification. It is illegal to base individual placement decisions on presumptions and stereotypes” ( FAPE | Free Appropriate Public

For example, I cannot use my opinion based on previous students with similar challenges or disabilities to recommend placement for a particular student. "The lack of a substantive definition of a FAPE in the IDEA has led to frequent disagreements between parents and schools regarding what constitutes an appropriate education for a particular student” (Yell, 2018). This has meant that there have been several litigation cases involving FAPE with the courts left to determine what the exact definition of FAPE is. Knowing and understanding this litigation, "schools can help ensure that they develop and implement appropriate special education programs for students with disabilities”(Yell, 2018). One case I found truly interesting to note was the Age v. Bullitt County Public Schools (1982) court case where the Appeals court ruled that just because a better program existed, did not mean the school's offer of FAPE was inappropriate. This is incredibly comforting to schools, and teachers, to note that their program does not have to match the very best quality to still be an appropriate offer of FAPE. Understanding and being familiar with the components of FAPE and the specific guidelines and regulations under it, helps me to better advocate for my students when speaking to individuals and conducting IEPs. How are FAPE and IEP implementations related? FAPE and IEP implementations are related in many different ways. Free appropriate public Education and an Individualized educational plan run hand in hand together. Without one you can not have the other. Free appropriate public education is education that is free to all students with disabilities and services included in FAPE consist of an IEP. All and any component of the IEP has to be implemented to be following the educational rights of FAPE. Both FAPE and an individual educational plan are part of the foundations of the IDEA.
