Discussion #2
Select one benefit and compliance issue identified in Module 3
and share why you feel it is a potentially risky one of which all organizations need to be aware.
Use a minimum of one reference from the class materials. No need to respond to other students.
One important piece of law that forbids discrimination on the basis of pregnancy, childbirth, or related medical problems is the Pregnancy Discrimination Act of 1978 (PDA) which amended Title VII of the Civil Rights Act of 1964. All work policies must refrain from discriminating against pregnant women. UMGC (n.d.) states that employers must not treat pregnancy any differently than other medical illnesses covered by the medical benefit plans, which has implications for benefit practices. Basically, the same standards that apply to other forms of disability must also apply to employees who are pregnant. Pregnant employees benefit from the PDA, but companies also need to be mindful of the compliance issue because breaking this law may have serious consequences. If an organization violates the PDA, there may be fines, penalties, and legal action taken against them. A company's reputation might be effected, and expensive litigation could arise from discriminating against pregnant employees or from failing to provide adequate accommodations.
