Activity for 10/20/23 class Please use Chapter 6 of your textbook as a guide for this activity. We will review this assignment in class on Wednesday 10/25/23. Topic 4 objectives: 1. Explain the extent of probation services typically offered. 2. Evaluate the contributions of Problem-Solving Courts and Specialty Dockets. 3. Evaluate the contributions of special court services. Building on Wednesday’s activity, please answer the following questions in 200-300 words each: 1. Have specialized courts been effective? Why or why not? - Specialized courts have been effective in a way but not as much as expected. This has helped tremendously because innovative decisions are made frequently to avoid a decrease in how effective specialized courts are. As years pass the recidivism rate is not constant because it increases and then decreases. Specialized courts offer programs and procedures to ensure situations are thought through thoroughly and effectively to avoid recidivism. “Specialized courts effectively reduce recidivism and improve public safety by providing categories of offenders who are at risk of chronic reoffending or who could benefit from rehabilitation with the resources they need to address underlying issues that can lead to preventable deaths and injuries. Mental health, drug, and veterans’ courts are among the most common examples of specialized courts, although jurisdictions across the country have applied the specialized court model to other categories of offense or offender. By promoting treatment and rehabilitation, these courts can help treat and eliminate several major causes of preventable death in the United States.” (GOV, 2019, pg.2). During these procedures, it is important to have good decision-making techniques because, in each specialized court, one topic is focused on the recovery of individuals. 2. What are the threats to the success of specialized courts? - The threats to the success of specialized courts are being too lenient with crime punishment. This is a threat to the success of specialized courts because most inmates are not punished enough and come back to jail. “Possible threats to specialized courts are several. Some people think they are simply the latest of several fads that criminal justice has seen over the years, others feel these courts are too far removed from what courts should really do, and still, others believe th ey will fail to thrive without complete judicial buyin. Specialized courts may also b lur historically clear role distinctions, lack a strong enough research base, be sof on crime, work for certain individuals better than others, and even be unconstitu tional.” (Siegel 2018, Pg. 148). This threat is important to recidivism in many ways. This could substantially lead to many other consequences for victims of the
crimes committed. This put the specialized courts at risk of not considering different factors and not having the necessary knowledge of the subject matter. Focusing on different matters at once can increase the rate of recidivism and cause many individuals to re-attend prison. If individuals re-attend prison, can cause many other consequences to the justice system. 3. What are the keys to the success of specialized courts? - The key to the success of specialized courts is by following other courts that have succeeded and follow their steps to ensure the success of the each specialized court. “Perhaps the most significant predictor of future specialized-court success is that they need to be viewed differently from traditional courts. It is also necessary for court personnel to adopt a different mindset with respect to these courts- the focus should be on underlying problems rather than on single criminal incidents. Additional recommendations to ensure the longevity of specialized courts include pooling resources, attracting support, and training.” (Siegal 2018, Pg. 148). By viewing each specialized court differently and focusing on one subject matter can help with having more knowledge on how to fix the problem other than focusing on many situations at once. This ensures the specialized courts are expanded to success with final decisions. Also, focusing on how the victims were affected is key to understanding what the possible punishments can be through a moral aspect and not focusing on financial. Every different specialized court has a specific issue to resolve. By adding programs to focus on the given subject can help increase the successful rate of attaining justice in the courts.
