EDU239 LESSON 1 ASSIGNMENT Answer each of the following questions in short-answer format ( four to six sentences). 1. How have legal cases impacted the policies and laws governing language instruction? (i.e., Lau vs. Nichols, Castaneda vs. Pickard, Flores vs. Arizona, Plyer vs. Doe) When civil rights for students were being questioned, the impact of legal cases started to come to life. Lau v. Nichols fought for non-English speaking students who were only being taught in English to equal educational opportunities. This made sure that students who may be from different countries had equal opportunity to learn in an American classroom where instructions were only given in English. Another way that has impacted policies and laws that govern language instruction is the preparation that is required for teachers. Flores V. State of Arizona led to all teachers being required to take courses that include language and literacy development. Therefore, the teachers can be well prepared when they have students such as the ones from Lau v. Nichols, who do not speak English but are in an English-speaking school. 2. What impact do federal laws and requirements have on accountability, assessment, funding, and identification in EL education in AZ? (i.e., ESSA, Title III, Title VI, Office for Civil Rights/Department of Justice Resolutions) ESSA’S Title III requires schools to identify students who speak English and have a disability and students who are English learners who do not have a disability which is crucial, so ELs progress is monitored correctly. In addition, states must have an English proficiency assessment with an accountability system that includes 4 academic indicators and 1 non-academic. Title III provides funding so Els continue to become proficient in English with supplemental programming that promote family and community language instruction. Title VI requires that schools are able to identify when an Els no longer needs additional support as well as make sure Els who were moved on too soon receive additional learning support. All these federal laws and regulations help support Els
from the start of their English education, during it and after. 3. How have state laws and policies impacted language acquisition methodology, student grouping, and the time frame to achieve language proficiency? (i.e., Prop 203, House Bill 2010, House Bill 2064, SB1014 and MOWR) Methodology was impacted by SB1014 by allowing more flexible methods such as bilingual programs for Els. Prop 203 helped group students who needed more support in their own space for more targeted learning. Prop 203 also requires Els to be fully integrated into English-speaking classrooms in the timeframe of two years. This created a questionable impact as some students may need more than two years to be able to function in an English only classroom whereas the timeframe of two years may provide a more efficient program to integrate the students with their English-speaking peers.
