6-13c Study Questions 1. Describe a situation that might place a medical assistant in the position of being negligent. If the medical assistant was asked by the doctor or nurse to transport a patient. The object that the patient is transported on has a broken wheel and the patient falls because of it. The medical assistant could be found liable if the patient is injured. 2. Describe a situation that might cause a medical assistant to be charged with medical malpractice. A situation that might cause a medical assistant to be charged with medical malpractice is the assistant tells the patient to take a drug to help stop pain. 3. List the qualifications for an expert witness in a legal action involving a medical assistant who works in a pediatrician’s office. Must have a personal experience in the field Must have educational background in the pediatric medical field Must have a license to practice medicine in pediatric medicine Be board certified in pediatric medicine Be a specialist expert witness 4. What is meant by the following: “Even if a doctor wins, he or she loses in a medical malpractice lawsuit”? This means that the people may still look at the doctor as being knowledgeable because of the malpractice lawsuit. 5. What relationship is necessary between a physician and patient to establish duty of care for the physician? There must be a professional relationship between a physician and patient to establish duty of care for the physician. 6. List the elements of a medical malpractice cause of action. There was a physician–patient relationship. This relationship established duty by the physician to the patient. The duty had been upheld at a professional standard of care. The physician breached the duty to the patient. The patient had a resulting injury. The physician’s breach was the proximate cause of the patient’s injury. 7. A newly diagnosed cancer patient comes to your desk after being informed of two alternatives for treatment, one involving surgery and the second involving chemotherapy. He asks your advice. How do you handle the situation? I would refer the cancer patient to speak with the doctor because I am not qualified to give advice. 8. List, define, and give examples of the five defenses available to a defendant in a medical malpractice suit.
a. Statute of limitation- particular number of years someone can sue a person after the incident. Ex: A child has until he/she is 28 to file criminal charges against an abuser. b. Contributory Negligence- patient is partly responsible for their injury. Ex: The patient mixes their meds together against the doctor’s advice. c. Comparative Negligence – the plaintiff’s own negligence contributed to their injuries. Ex: The patient does get money for mixing medicine together but not as much. d. Assumption Risk – patient had knowledge of the risk and voluntarily chose to accept the risk. Ex: If you go to a baseball game and get hit in the head with the ball. You can’t sue for getting hit when you chose to go sit in the stadium to what the game. e. Emergency – doctor is faced with an emergency and the standard of care is different so they may not be held liable for any result of harm 9. An automobile accident occurs in front of your office. You hear the crash and go to the door to see what has happened. One of the passengers in the car is walking around the street in a daze with blood dripping from a facial laceration. What do you do? If you chose to help the victim then you can’t leave them until someone else comes along to help. If you choose not to help, you have np legal duty to help them. 10. Prepare a question for your employer to determine whether his or her malpractice insurance covers a medical assistant working in the office. Are accidents and injuries covered by malpractice insurance while I am performing my work duties? 11. An individual comes onto property owned by the medical office, is drunk, has been told to leave, but remains in the building. There is a floor board in the front hallway that everyone knew needed to be fixed, but nothing has been done about it. The individual falls when the board gives way and breaks his leg. What is the responsibility of the medical office? The medical office is obligated for the safety of the person on their property whether invited or not. I would put up some signs to make people aware of possible dangers . 12. While sitting in the waiting room of a medical office, a patient falls when the chair gives way under him. The man is a very heavy person and chose to sit on a regular chair. There was a large chair available for him. The patient ends up in the hospital for observation and later for pneumonia related to his inactivity. Who is responsible for the pneumonia? I think the man is responsible for having the pneumonia. He chose to sit in a chair that was to small for him while one that could have fit him was available in the waiting room. 13. List equipment one might find in a medical office that could injure a patient and give rise to a product liability claim. Surgical tools, anything with sharp edges, power issues with different devices
