Dr Susan White Australia n Sports Drug Medical Advisory Commit ee Strongly support - The Australian Sports Drug Medical Advisory Commitee (ASDMAC) strongly supports the proposed regulatory changes as it will provide increased clarity for athletes, sporting organistaions, Medical Practitioners and other athlete support personnel about the regulatory framework for Sports Supplements. - There are a number of studies demonstrating the presence of World Anti- Doping Agency (WADA) Prohibited Substances and Scheduled Poisons in sports supplements available for sale in Australia. The ASDMAC feels that increased regulation of sports supplements will reduce the risk of an Anti- Doping Rule Violation (ADRV) for athletes and helping to protect the health of the athlete and that of the broader Australian population. - What are the reasons for your answer? Any clarity around sports supplements regulation will reduce the administrative burden of athletes and sports in Australia. Somewhat positive - ASDMAC believe that the proposed declaration would have a 'somewhat positive' impact on the availability and choice of sports supplements for athletes. - Athletes will still have access to a wide variety of sports supplements that are of a higher quality and safety due to the declaration. - ASDMAC would also welcome increased regulation and post market testing of supplements to ensure compliance with TGA requirements and further reduce the risk to athletes of poisons or WADA code banned substances. - The ASDMAC believe that the proposed declaration will provide greater clarity for consumers, including athletes, NSOs and prescribing practitioners. - The current regulatory system is complex for all to understand as products which may appear similar can be subject to different regulation. - The regulation will also reduce the ability of industry to exploit loop holes to produce and promote sports foods with significant health claims and risks. sports supplements, feel that the proposed declaration should have a positive impact on athletes and the broader sporting system in Australia - As Medical Practitioners, the ASDMAC has ongoing concerns about the potential negative health impacts of some sports supplements due to the demonstrate d presence of Scheduled Poisons and WADA Prohibited Substances. The proposed declaration is expected to have a positive impact on the health of athletes, and others, who use sports supplements. - As key advisors to athletes and sports on the anti-doping and health risks of supplements the ASDMAC feels the clarification of sports supplements at the food : medicine interface will reduce the administrative burden for athletes, sports and practitioners. - It is likely to have significant impacts on the well being of athletes who may be subject to severe sanctions from an anti-doping rule violations (ADRVs) as a result of taking supplements that contain WADA prohibited substances (which at times are not clearly labelled as such) and regulatory change resulting in the reduction of supplements containing WADA banned substances is welcomed

Netball Australia feel that this would have a positive impact on athlete choices by making the selection of sports foods and supplements a simpler process where athletes and medical support staff can have more confidence that the product presented accurately represents its claims and contents As a sport with a high participation rate and an evolving group of professional athlets, this proposal will make for greater surety in the selection and provision of supplements, encouraging the use of supplements that are both effective and safe Not provided Strongly support Because they have misleading claims, and can be harmful to some people. Removal of questionable and unsafe products from the shelves may result in less products, however these would be safe and reliable As a dietitian I am constantly myth busting misinformati on regarding supplements. They will be able to have access to regulated supplements, which have undergone testing and can be confident that whatever it is they are using will bring no harm to them. Somewhat agree Most capsulated/ oils products on the market that are not well known. These are products and manufactur ed locally and sold discreetly to local stores. Because they are not popular, they can't be found that easily. But they do exist, and there are a lot out there. None of them are AUST L listed and most contain banned ingredients in them. Somewhat positive As a supplier it will level the playing field for everyone in the industry and will also keep the consumer safe. Take a walk through some of western Sydney's supplement stores. There will be at least 30% of products in the stores which are all unregulated. There are numerous products that should be therapeutic good that masquerade as foods, yet contain herbal medicines or ingredients that are not permissible in Australia. Furthermore, some products do not declare their active ingredients or the amounts of their active ingredients. Most present themselves in tablet or capsule dosage form along with therapeutic claims. They present themselves as therapeutic goods and therefore should be treated as therapeutic goods. It will have a positive impact for consumers. That way they know what there are getting in a supplement, the ingredients are writen clearly, and the indications can be verified by an evidence package. It will also mean that ingredients will be those that are permissible and in amounts that are also permissible (e.g. caffeine) Yes, there will be greater clarity as the product will be defined as a therapeutic good and follow legislation and appropriate therapeutic goods orders. Products manufactur ed overseas not under GMP standards could still be imported by sports stores and sold to the public. Some supplement companies and stores are boasting about not following the legislation and that they will keep selling overseas products. There needs to be protection against this practice. Australian companies following the legislation and therapeutic goods orders need to be protected. Essentially a positive impact on my business and that of the industry as a whole and the reputation of supplements would be increased. Current marketing practices and food standards make it very difficult for consumers to make informed decisions about the level of safety and efficacy of a product. Somewhat disagree Again, it is a murky industry and I think there are plenty of producers out there that would make false claims about their products medicinal benefits - fancy marketing for charlatan tinctures that folks have been trying to flog off to us since the gold rush. exacerbate mental health problems that drive disordered behaviours like abusing sports supplement s. Weight loss and muscle building supplement s in all forms pose risks to health. Vulnerable consumers and especially those aged under 18 years (one of the largest growing categories of users) should be protected from these goods. They have strong lobbying capacity and will speak out against this proposal. It is in the interests of the health of all Australians that these dangerous products become more highly regulated. Classing them as therapeutic goods is a good first step and must be taken by Government to ensure that no more lives are lost to these products. The already regulated supplements would become very much unregulated by people buying products on line overseas which is very unregulated At least in my shop with the current regulations you have hope that people come in get educated and leave with an Australian regulated product. Essentially, if the product is in a capsule, tablet, or liquid with therapeutic ingredients, making therapeutic claims, and purchased for therapeutic reasons = it is a therapeutic product and should go through the same process as other products Listed on the Australian Register of Therapeutic Goods (ARTG). Sports supplements are typically in tablets, capsules, liquids, and powders presenting themselves as therapeutic goods. Sports supplements are therapeutic products. That's why people take them. ***The TGA must protect the companies who are doing the right thing by making it illegal to import sports supplements from overseas and selling them in Australia. There are several Australian companies who List their products on the ARTG and follow the legislation. Positive impact. It will improve the quality and stability of sports products and make them known worldwide as the highest level of supplements. Listed products have a high reputation worldwide where overseas companies use Australia as the benchmark of quality. It will also clean up the supplement available to children and adolescents who are more greatly affected by low quality products, many with illegal or dangerous ingredients. It will also put the cap on caffeine, where non-TGA products have no limit Goods that present themselves as therapeutic, either by dosage form, ingredients, dosage amount, label, marketing, etc = are therapeutic goods. Herbal medicines and chemicals that mimic hormones and anabolic steroids are not foods... Yet a lot of sports supplements use chemicals in their products as call them foods. They heavily promote themselves as food supplement s. There are several companies stating that they are being hard done by from this proposal - yet they are the one's misleading the public and putting them to harm. They don't report adverse reactions as they don't follow GMP standards, legislation, or advertising code. I know of companies who have hidden adverse reactions. It will show that quality products are available in Australia. Those that follow the legislation and advertising code are beter off. Please protect the companies already following the "rules" and Listing their products on the ARTG. Please safeguard the Australian public from overseas inferior products.
