Side: Against Life Tenure
This article is addresses the problems with a life tenure for Supreme Court Justices. They begin their argument by opposing the U.S. Constitution, which states that Justices can hold their position in office for life. The author explains that life tenure is not as appropriate for modern day as much as it was
when the Constitution was written. They explain the “subtle but serious” problems: decrepitude, intellectual autopilot, hubristic complacency, unaccountability, randomness, uglier confirmation battles, eroded legitimacy, and diminished productivity. The author ends their article by explaining a proposed 18-year term-limit that would eliminate the problems they mentioned.
Should I choose to support a term limit for Justices in my essay, I would use this article as grounds to support my reasoning. Also, I could use this article as backing for my warrant, as it explains why a life tenure is actually problematic. If I choose the opposing side, of supporting life tenure, I could use this as information to explain the opposing side for my rebuttal.
