Discretion can be used in many and all different ways. An officer who pulls an adult offender over for speeding or any minor traffic offense, the officer can use discretion with these types of violations. Now using discretionary power and if pulling over a juvenile for the something by the same officer and that officer might cite the juvenile to teach a valuable lesson so that in the future, he won’t commit the offense again in the. “There are many instances throughout a police officer's day-to-day work where they can decide how to respond to a situation using their own best judgement and wisdom rather than a strict law.” (Liddell, 2003) The relationship between authority, integrity, and discretionary power are all similar in their own way but can join together in a positive way. Integrity; The quality of being honest and having strong moral principles. Authority; is the power to determine, adjudicate, or otherwise settle issues or disputes; jurisdiction; the right to control, command, or determine. Thus, you have Discretionary power; which refers to the authority or ability to make decisions based on one's own judgment or discretion, rather than following strict rules or guidelines. With the situation that was presented towards the pursuit and how it played out it would be important to figure out a smart solution by bring those three keys into play and showing understanding with the roles. Ethics is a moral principle that manages a person’s behavior which is a common role with Law Enforcement. Those morale principles are a learning curve that teaches those right and wrong and can be a teachable lesson when someone is in the wrong. Acting in an unlawful manner because your demeanor is off that day usually makes you abuse your authority in which can interrupt your discretionary power in certain instances. Discretionary power is for helping those and the communities that we sworn to protect.
Given the scenario, it comes down to the safety of both the driver and the passenger; especially the female passenger which showed the she was in labor and the driver ultimately putting his hands up and shouting at officers of what was taking place currently. With the actions I would ultimately radio dispatch to slow all crews down and explain over the air the situation as brief as possible and then assist the victims by getting them into the hospital, Once the female is in safe hands, I would ask the driver for a quick conversation about what had taken place and that this incident could have been much different in other circumstances. This is where your moral and ethics come into play along with the important roles. I would simply give a verbal warning and explain the situation have it unfolded. I would let him know that he did break the law and he could very much be going to jail today. My discretionary power gave me the tools in this situation to handle it the correct way, especially visibly seeing the scenario unfold the way it did. My ethics and morals also came into play rather quickly Since I was in a similar issue with my wife and daughter; I completely understood his shoes. I since cancelled all units and then explained the results to command. I also made sure to explain to the driver that the feeling your about to experience is unlike any other and congratulated him and said “now go get ready to be a dad.” The option to arrest the male for the birth of his child would have put a micro scope on me and any other officer for not being human and being robocop. The courts would have not been happy or pleased for the fact that arresting the male was a harsh and unfortunate circumstance. This case would have been most likely dropped because the way it turned out. If he was sentence, I could see community service or paying fines for the traffic violations. Being a new father, this man would have learned a valuable lesson with his decision making and the safety of his driving. This situation could have gone a completely different way and different
