CASE NAME Engel v Vitale CASE DATE 1962 CHIEF JUSTICE Earl Warren AMENDMENT/CLA USE First Amendment, the establishment clause of the first Amendment BACKGROUND & DETAILS OF THE CASE In the state of New York, there is a law that makes it mandatory for all public schools to say the pledge of allegiance at the beginning every day. But even though it was mandatory, the regulation let students to not be part of the pledge of allegiance if they didn’t agree with it or saw it offensive or disagreeable. But one day, an involved parents sued, asserting that the rule defied the initiation of the 1 st amendment. COURT RULING The ruling was that having school-advocated prayer goes against the 1 st amendment, which is the freedom of speech. The supreme court decided that states cannot hold prayers in public schools even when participating in it was optional, and even when the anthem was not tied to a specific religion. CONSTITUTIONAL ISSUES & SIGNIFICANCE The constitutional issue with this case is whether school- advocated prayer which is nondenominational, in school goes against then initiation of the 1 st amendment in the constitution. This decision is significant because the outcome is seen as a triumph for some people because in a way it means religious freedom. But on the other side, it was blamed by some people who saw it as messing with America’s religious traditions. gopopro.com
