I believe it is important to treat people equally under the law and know it would be a dangerous precedent to begin judging protesters based on their demographic. However, I also understand the history of colonialism and believe in the sensitivity and validity of Indigenous protests. I also believe through law and public policy, Indigenous people should be given their constitutional right to protest, free from police violence, public outrage, and lack of productive government response. I agree with Peter Russel that Indigenous protests are truly “flashpoint events.” Most Indigenous protests I have learned about, including the Ipperwash Crisis and Idle No More, have many things in common which Russell has pointed out; such as causing disturbance but little violence, is erupted by violation of treaties or obligation, and ‘fruitless’ resolution efforts by the state (Marder, 2023.) These protest characteristics are different from others, such as union/worker protests, or the Freedom convoy “movement.” While these protests can be based in illegal activities, such as trespassing, it is often the best or only way for Indigenous people to take action and get their message out. For Canadians who can easily access voting or things like town hall meetings, or be taken seriously when they ask calmly for change, Indigenous people often are not granted the same rights as other protesters.I think because of the cultural sensitivity of the issues and the deep history; the state, while of course needing to further their interests, need to be more careful and sensitive in dealing with these protests. Dating centuries back, police officers and those in power have been taught to be weary of Indigenous people, in turn making Indigenous people weary of them (Marder, 2023.) Police officers have a bad history with Indigenous people and minorities in Canada, and it is no wonder the relationship between the two are strained. The law needs to be more inclusive of Indigenous people and what their specific and special rights are in order to give a formal
framework for police training and better management of these situations, to begin trying to repair this relationship. In the example of the Ipperwash Crisis, sending the OPP to the protesting site, rather than people like negotiators, was a mistake. Both the First Nations protesters and OPP believed the other side was planning an attack, causing escalation which led to the OPP Emergency Response Team, the Crown Management Unit, and the Tactics and Rescue (Marder, 2023.) This is just one example of police units not knowing how to respond appropriately, causing unnecessary altercation with Indigenous people, and ultimately causing more harm than good. Anthony O’Brien was shot by a police officer and the police later claimed that O’Brien had pointed a firearm at them (Marder, 2023.) The controversy that comes from these events often swallow the intended purpose brought up by Indigenous people. WIth proper treatment, tragedies at supposed peaceful protests would stop, change could be made, and Indigenous-police relations could begin to heal. However, the government would have to find a way to listen and respect Indigenous people, give them access to make change, instruct authorities on how to handle these protests better, and give Indigenous people proper rights to freedom of speech.
