Judicial Review was established by the Maubray vs. Madison case. Judicial Review is where the Supreme Court decides whether a law is constitutional or not. S upreme Court can strike down acts of Congress it considers unconstitutional. I think this is very important because it allows the Supreme Court, to check up on the Congress and makes sure it’s following the Constitution. What I found very interesting was that Judicial Review was never guaranteed by the Constitution it just came about in the Maubray vs. Madison case. he Constitution states that it is the supreme law of the land. There has to be an authority to decide whether a particular law is constitutional, (Supreme Court) Without it the legislative branch would be free to pass any law without regard if it’s constitutional or not. Judicial authority has always included the power to interpret laws. There are different types of courts, SUPREME COURT SELECTION and the Lower COurt Selection. In the Supreme Court Selection, the president nominates replacements for deceased or retiring justices. Typically the nominees are personal friends of the president.Also all nominees undergo an FBI background check. In the Lower Court Selection, The president is less involved in the selection of judges. What I think is very neat is that interest groups use the courts to shape the public policy. Lawsuit help interests groups achieve their goals faster than do elections. For example, in the 1690’s liberal groups used different lawsuits that were presented to expand civil rights, civil liberties and environmental policies. I think that the people have a great impact on cases.
