Describe the majority opinion (the winning side) The majority of the Court agreed with Johnson and held that flag burning constitutes a form of "symbolic speech" that is protected by the First Amendment. The Court found that Johnson's actions fell into the category of expressive conduct and had a distinctively political nature. 3. Describe the minority opinion (the losing side). The minority argued that the flag's unique status as a symbol of national unity outweighed "symbolic speech" concerns, and thus, the government could lawfully prohibit flag burning. 4. Why do you think the case concluded as it did? In my opinion | believe that nobody can suppose that this one gesture of an unknown man will. It’s better to change our Nation's attitude towards the flag. | also think that the Supreme Court choose this decision because they agreed that symbolic speech—no matter how offensive it was—is protected under the First Amendment. 5. Why do you believe this case is a landmark Supreme Court case? A landmark S.C. case is a case of great importance.
