Takings Case

Read the following: Takings Clause in the Fifth Amendment to the U.S.
Constitution; the essay on property by James Madison; Chapters 36–40 of
Understanding Property Law regarding governmental land use regulation;
and, the Bible passage of 1 Samuel 8:4–22.

well-written post whether the U.S. Supreme Court decision in
Kelo v.
City of New London
(brief discussion in the text and available at
JFLibrary link to Westlaw) (A) correctly applies the Founders' intent
for the Takings Clause in the Fifth Amendment to the U.S.
Constitution; and, (B) whether the decision is consistent with James
Madison’s view of property and relevant biblical principles in the
passage of 1 Samuel 8:4–22.
