Journal 5-2: Legal Concerns Stephany Rosenau Southern New Hampshire University HSE 315: Role & Impact of Trauma Bethanne Shriner December 3, 2023
It happens occasionally that human service professionals face dilemmas that need to be considered from a legal and professional perspective to ensure that the client has the best possible outcome. A legal concern that I may have when working with a client who has suffered a trauma is that of confidentiality. Everyone has a right to their privacy and for any information provided to be kept confidential unless the provider feels they need additional assistance with the client’s case. Practitioners must ensure they only share information about the case with other professionals and only vital details that need to be shared, nothing more. Clients also have the legal right to providing informed consent. Without informed consent a client may not be assisted in the proper ways. A secondary intervention that I would utilize would be screening and assessment tools. If I were working with children, I would utilize the CTQ (Childhood Trauma Questionnaire). This screening tool evaluates for physical, sexual, and emotional abuse, as well as physical and emotional neglect (SAMHSA, 2014). By identifying the types of traumas experienced by the child, an appropriate plan of care can be created to help the child. Other screening and assessment tools can be utilized based on the appropriate nature of the tool to the scenario of the client. A tertiary intervention I would utilize would include Cognitive Behavioral Therapy. “Therapists employing CBT may encourage patients to re-evaluate their thinking patterns and assumptions in order to identify unhelpful patterns in thoughts.” (American Psychological Association, 2017). This type of therapy can help clients understand that their negative behaviors are a result from the trauma they have experienced. By recognizing the triggers and the behaviors associated with the triggers, the client can work towards changing those behaviors in a positive manner.
