CNL-505 Topic 7: Scenario Analysis Worksheet Directions: Read the four scenarios below. Provide a 200–300-word response to the question in all four of the scenarios presented below. Cite the HIPAA Guidelines, ACA or ASCA Code of Ethics, and other scholarly resources to support your responses. You must provide at least one properly formatted APA citation and accompanying reference to support your response for each scenario. Scenario One: A need for a process group for domestic violence victims has been determined. Barbara has been asked to develop a counseling group to serve the needs of these individuals. Question: What ethical considerations and advocacy strategies should Barbara consider as she develops a comprehensive plan for this group? What methods should Barbara use to ensure confidentiality and safety in the context of group counseling? If breaches of confidentiality and/or safety concerns occur, how should Barbara address them? Answer: Facilitating a group can be challenging for a counselor as there are multiple dynamics in play during a counseling group that are not present during traditional counseling sessions. It is important for Barbara to complete a proper screening of possible participants. The goals of the clients should align with those of the group (ACA, 2014). It is important that participants do not impede the group process and that they do not disrupt other members progress and their well- being (ACA, 2014). The ACA code of ethics also states that counselors must protect clients from any physical, psychological, and emotional trauma (ACA, 2014). Per ACA Code of Ethics Barbara must clearly outline the importance of confidentiality for the domestic violence group (ACA, 2014). Another method pertaining to confidentiality that Barbara could use is the informed consent process. Informed consent is the first step in protecting the rights of a client (Corey et. al, 2017). She can utilize an informed consent document to clearly define boundaries and outlines the counseling dynamic (Corey et. al, 2017). The informed consent process also allows clients to make decisions on whether they chose to participate in the therapy. Utilizing informed consent is both an ethical and legal obligation of a counselor (Corey et. al, 2017). If there are breaches of confidentiality Barbara should seek consultation or supervision on how to address, it within the group dynamic. Scenario Two: David is a licensed professional counselor (LPC) and a licensed marriage and family therapist (LMFT) working for a family counseling center. Steve, one of his adult clients, would like to begin couples counseling with his wife. Question: What ethical matters should David consider before beginning to see Steve and his wife? What special issues of confidentiality may arise in the case? How should David address these issues? How might differences in personal values and gender/cultural issues create ethical dilemmas in this case? Answer: Confidentiality becomes more challenging when counselors work with multiple people in one room (Corey et. al, 2017). Ethical issues regarding confidentiality become more complex and unique when practicing couples therapy (Corey et. al, 2017). During couples therapy a counselor must clearly define who is the client and discuss limitations to confidentiality. Counselors must attempt to have an agreement in writing that outlines the agreement of confidentiality (ACA, 2014). During the informed consent process David should outline all expectations of confidentiality and must set boundaries with the participants. Couple counselors should inform clients that they do not hold family secrets and they do not plot against another party (Corey, et. al, 2017). A special issue around confidentiality with couples may result when a counselor is having individual and couple sessions. A counselor may outline that they will not withhold information provided to them during individual sessions or that they will. This is up to counselor discretion on what boundaries they will set. An example of a dilemma is when a client discloses and extramarital affair during an individual session. This can be viewed as collusion between the therapist and client and should be avoided (Corey, et. al, 2017). Scenario Three: Stephanie is a licensed professional counselor (LPC) who has decided to start a private practice as she transitions from public to private practice. As she makes her plans, there are many ethical issues she must consider. While these issues are of concern to all counselors, she must consider how they specifically impact a counselor in private practice. Question: How can she ethically handle limited resources, deal with cost containment issues, respond to discrimination, and promote community change? As a service provider, with what ethical issues and practices related to state insurance laws and managed care must she be familiar? What best practice community-based interventions could she refer her clients to? Answer: It will be important that Stephanie reviews her respective state laws regarding professional scope of practice (Corey et. al, 2017). Stephanie must ensure that she has the appropriate certification and license to conduct her own private practice. Licensure and certification provide reassurance to the public that the provider has had the necessary education and training to provide a service (Corey et. al, 2017). Stephanie must be able to demonstrate competence in her area of practice. Stephanie must have ongoing education about community resources in case she is not able to competently serve her client and she must make an outside referral. Stephanie has a professional responsibility to take on a role as an advocate. She must be able to promote change at all levels while removing barriers for all groups to improve quality of life for clients (ACA, 2014). Stephanie must be familiar with insurance benefits for clients and be aware of possible denials as it will reduce conflict.
