Discussion Post #1 Due Sunday, November 10, 2019, by 11:59 p.m. (Chapter 7 & 8) (10 points) Your discussion should exhibit careful thought and logical reasoning and provide evidence for your position. You must explain and provide examples for your answer. You will be required to cite at least one scholarly source in your discussion post using proper APA formatting. Each post should be at least 300 words , and use correct spelling, punctuation, and grammar.  You are also required to read and reply to two other students. Your replies should be at least 150 words each and offer new substantiated ideas or thoughtful questions. I encourage friendly debate and disagreement, but ask that it be courteous and respectful. You must complete all three components (1 original post and 2 replies) of the discussion in order to receive full credit. Partial credit will be given. The discussions must be completed by the due dates specified on the Syllabus. Late postings will not be accepted and will result in a zero. Original posts will be worth 5 points and each reply post will be worth 2.5 points adding to a total of 10 points per discussion assignment . Directions: Answer 1 question from each of the following chapters. Chapter 7 1. What are the benefits and consequences of using mandatory arrest policies in cases of domestic and intimate partner violence? How would you improve the criminal justice response to cases of domestic and intimate partner violence? Explain and provide examples for your answer. Mandatory arrest policies are policies where police officers have the legal duty to make an arrest if they believe that domestic violence has happened (Mallicoat, 2018, p. 148). A benefit of these policies for victims is that they no longer have the responsibility of deciding if the perpetrator should be arrested (Mallicoat, 2018, p. 148). This is beneficial to victims because often times these victims are wanton, as they are vulnerable to this violence, and blocked so they are unable to defend themselves. Research shows that these policies have been beneficial to victims as the arrest rates for intimate partner violence have risen (Mallicoat, 2018, p. 148). Even though these policies are beneficial, they also have consequences which include the requirements of the mandatory arrest policies. Police officers are required to make arrests within hours of the assault depending on the state; for instance, in Alaska and Missouri, the report has to be filed within 12 hours of the assault and in Washington State and South Dakota an arrest has to be made within 4 hours (Mallicoat, 2018, p. 148). The police officers are only allowed to make an arrest if the assault follows the definition of what domestic violence is, which in most states the individuals have to be married, blood relatives, or live together (Mallicoat, 2018, p. 148). This is unacceptable as individuals can experience domestic violence with partners that they are not married to. It is unfair that there are restrictions to domestic violence as dating relationship can also have domestic violence present. Another restriction of these policies is the gap of uncertainty that an officer has when deciding who the “offender” is, which frequently causes dual-arrests (Mallicoat, 2018, p. 148). This is unjust as the officer did not experience the domestic violence and cannot be certain which individual was the offender. I would improve the criminal justice response to cases of domestic violence and intimate partner violence by allowing individuals to have a voice so that the officers do not have to assume who committed the crime. By doing so, it can help reduce dual-arrests as well as discrimination faced with dual-arrests. Also, I would expand the definition of domestic violence to include dating relationships as a domestic relationship, since domestic violence can occur while dating. According to Eitle (2005), the difference in arrest risk in jurisdictions with a mandatory arrest policy and without one was 5%, where it was 50% vs. 45% (Eitle, 2005, p. 591). Since research shows a minuscule difference of the arrest risk with and without these policies, I would contemplate removing mandatory arrest policies in order to reduce dual-arrests and arrests because of discrimination. 2.
