18th Amendment Failure

Between 1900 and 1913 more Americans began to drink more and more alcohol with the production of beer jumping from 1.2 million to 2 billion gallons; three times more alcohol than the average American drinks now.1 Prohibition was a movement sparked by women since women thought they were the ones who suffered the most from the cause of alcohol and women though that alcohol was a threat to a happy family. Women wanted to pass prohibition because many men would go to saloons and go home and be abusive towards their wives and children. Women and other groups eventually got 46 of the 48 states to ratify the 18th amendment on January 16, 1919.2 The 18th amendment on article one says, "...the manufacture, sale, or transportation of intoxicating liquors within, the importation thereof into, or the exportation thereof from the United States and all territory subject to the jurisdiction thereof for beverage purposes is hereby prohibited."3 The first article on the 18th amendment is saying that the sale, making, or even bringing liquor into the United States or any of the United States' territory will now be illegal. Prohibition began to show its weakness right away when the United Sates government did not show much support. After the first year of prohibition the American people started to show less support and even led to organized crime. The Eighteenth Amendment made alcohol illegal. However, this amendment was not being forced. So congress put out a law, called the Volstead Act, to allow law enforcement to use force to enforce the eighteenth amendment.

The 18th Amendment was removed from the Constitution and replaced by the 21st Amendment on December 5, 1933. It was added because the government was also suffering from the Great Depression at that time. By removing Prohibition, the government would get taxes from alcohol sales, jobs would be created, and it would decrease the costs of law enforcement for Prohibition. The 18th Amendment was the only amendment that was ever abolished in the U.S. Constitution. An amendment is supposed to stay in the Constitution forever and acts as a law that is protected by the federal government. When the 18th Amendment was removed, it shows that the government thinks that it wasn’t effective. Organized crime made money from selling the alcohol and increased crime throughout U.S. After years, lawmakers agreed that prohibition was not effective but also dangerous to many laws and caused many crimes concerning the safety of the citizens. Thousands were called back to work for alcohol companies. More than 5,000 new jobs are predicted as a result of repeal and many celebrated the downfall of Prohibition. In 1919 the Constitution of the United States issued the 18th amendment, enforced into law as the National Prohibition Act of 1920. Prohibition is the banning of the manufacture, sale, and possession of alcohol, including beer and wine. This amendment was repealed with the passing of the 21st amendment to the constitution, allowing the possession of alcohol in the United States. In the City of Washington on Monday, December 5th, 1932 the 21st amendment document included the reestablished rights of the citizens restricted by the 18th amendment. (Appendix II) The 18th amendment was the first and only amendment repealed by the constitution, allowing people to possess, sell, and buy their own alcohol.

Imagine that you’re having a gathering or party. Everything is ready to go and then you remember that the 18th amendment prohibits you from buying liquor/alcohol. The party was supposed to be a blast, but how can you have a blast without alcohol or liquor. Prohibition was the 18th amendment. It stated that it was illegal to manufacture, transport, and sell alcoholic beverages in the United States. The Volstead Act added to the 18th amendment almost 9 months after. It added that when the 18th amendment went to affect, it was against the law to barter, import, export, deliver, furnish, or posses intoxicating liquor. Of course, drinking/usage was also banned, except for authorized purposes. Then it was repealed. It was the first, and only amendment in U.S history to be revoked.

Achievement of lowered crime rates in society is always ideal and it involves citizens to band together to eliminate deviant behavior with the help of government policy makers that create laws to instill fear for displaying reckless behavior. Those with deviant behavior cause violent incidents and many reformationists believed that alcohol caused this behavior. A popular historical example is the 18th amendment, calling for a complete ban of alcohol sales, transportation, and manufacture in the United States. The 18th amendment, also known as Prohibition was created in 1920’s and lasted for a little over a decade. Alcohol consumption was at an extremely high rate and many believed that alcohol was the reason for deviant behavior in society. This controversial amendment wanted to change individual behavior for the better because they believed alcohol increases the chance of recklessness, which can be prevented. Illicit production spread, despite many efforts for enforcement. To enforce prohibition, the Volstead Act was enacted in 1917 to carry out the 18th Amendment which ratified and became in effect in 1919. The 18th Amendment prohibited the manufacture, sale, and distribution of alcohol; however, it did not criminalize consumption. This allowed a black market of alcohol to thrive. There was no measurable gains from prohibition, as it removed much of the tax revenue, created organized crime, and led more people to purchase drugs such as opium as substitutes. All in all, prohibition did not achieve the goal to improve America, but instead added more problems that it was intended to prevent. This led to its repeal in 1933 by the 21st Amendment.

Herbert Hoover called it a "noble experiment." Organized crime found it to be the opportunity of a lifetime. Millions of Americans denounced it as an infringement of their rights. For nearly 14 years—from Jan. 29, 1920, until Dec. 5, 1933--the manufacture, transportation, and sale of alcoholic beverages was illegal in the United States. The 18th, or Prohibition, Amendment to the Constitution was passed by Congress and submitted to the states in 1917. By Jan. 29, 1919, it had been ratified. Enforcement legislation entitled the National Prohibition Act (or more popularly, the Volstead act, after Representative Andrew J. Volstead of Minnesota) was passed on Oct. 28, 1919, over President Woodrow Wilson’s veto.

The 18th amendment, or the prohibition law was a good and a bad thing for America in many ways. Prohibition was enacted to stop the derotation and violence of men against their wife and kids with the use of alcohol, and many people thought that alcohol was an ungodly corrupted thing in America which is why the 18th amendment was enacted to try to eliminate and dangers of alcohol. Alcohol was prohibited in many states before it became a law in the 1920’s for the whole state. Even though the government and women enacted the 18th amendment to prohibit alcohol to make things better in the US only made things worse and some things good that America’s wouldn’t even know would happen.After America saw what this 18th amendment was doing to the country they saw that it was silly to prohibit alcohol in the first place just to cause a lot of problems in the future which America did unintentionally.

The Eighteenth Amendment, created during President Wilson Era, prohibited the manufacture, sale, and transportation of alcohol. The Eighteenth Amendment was created because of the Women’s Christian Temperance Union (WCTU) that said that drinking alcohol causes a lot of problems in the society, but the WCTU couldn't establish any law for the prohibition of alcohol. So the Anti-Saloon League (ASL) was created to advance the ideas of the WCTU. The ASL convinced politicians to support the Women’s Christian Temperance Union using pressure politics. Finally, on January 17th, 1920, Eighteenth Amendment was created to prohibit the commerce of alcohol. The 18th amendment was the prohibition of alcohol which was then repealed by the 21st amendment. They prohibited it in the States because they believed it would benefit the people’s health and work ethic as well as reduced crime. It was largely supported before it was passed especially by female religious groups. It didn’t accomplish what they had hoped for, it had grown very unpopular, criminals were making lots of money smuggling it and people were brewing at home with unsafe conditions. Convinced that alcohol was the source of almost all crimes, Congress started what was known across the nation as “The Noble Experiment” in 1919. To begin this “experiment”, Congress ratified the 18th Amendment. This Amendment became known as, just simply, Prohibition. Prohibition was a ban the government put on the production, transportation, and sale of any form of an alcoholic beverage from 1920 to 1933. The goal of the government was to get rid of many of the problems that came with alcohol – such as crime, drunk driving, and other negative effects of alcohol. The National Prohibition Act, also known as the Volstead Act, was passed as the 18th amendment on October 28, 1919. The act prohibited alcoholic beverages with an alcohol level of greater than 0.5%. It also regulated the manufacture, production, use, and sale of alcohol.1 The Volstead Act was pushed for by many religious groups who believed alcohol was evil and detrimental to society. The intent of the Volstead Act was to decrease crime and corruption, boost the economy, and improve the health of the American people. Instead, it ultimately resulted in an increase in organized crime and corruption, the economy plummeted, and the rate of alcohol consumption grew rapidly. This is why I believe the Volstead Act was pointless and should never have been passed. It took over a decade for congress to realize their mistake and the Eighteenth Amendment was not repealed until December 5, 1933.

Instead, it added to the problems it was intended to solve.” On 16th January 1920, one of the most common personal habits and customs of American society came to a halt. Ratified on January 29, 1919, the 18th Amendment went into effect a year later. By that time, about thirty-three states had already enacted their own prohibition legislation. In October that same year, Congress had passed the National Prohibition Act. This provided guidelines for the federal enforcement of Prohibition. The Representative Andrew Volstead of Mississippi championed this. He was the chairman of the House Judiciary Committee. The legislation was more commonly known as the Volstead Act.
