About 3 weeks ago, mom came from Texas to get the children. Mom said she has full legal custody. Dad had the children for a two month time period for 2-3 weeks. He wouldn't let the mother know the children's whereabouts. Dad had the children because mom asked him to step in and help enroll them in school, buy uniforms, and school clothes. Dad took the children and ran with them. He didn't enroll them immediately but when he did they went to Woolmarket for two weeks. She was taken to the E.R. by the mother. Elizabeth told dad's ex-girlfriend that she was leaking on herself. She was too scared to tell dad she was hurting. Mom said dad's ex-girlfriend told her that dad got upset with Elizabeth and threw her on the bed and made her sit in the bathtub. She also said he grabbed her by the neck. Mom said the child has no marks or bruises that she could see. Elizabeth said dad told her if she went with the mother, he would have mom locked away and she would never see her again. The reporter stated on 12/05/15 the victim was brought to the emergency room and diagnosed with pneumonia. According to the reporter, Braxtyn’s condition is serious but it’s unknown if it’s life threatening. She was being dropped off at people's house that the family didn't know. Destiny was just trying to unload Avery. Mom had a break down but now she's functioning, getting her life back together, and going to church. When things got difficult for her, Destiny said they would just keep Avery to give her some structure. Renee said Destiny and Justen lived with too many people in different places. PER REPORTER: Charlie said today five year old Makiyah was brought into the emergency room in Chicago, IL by her mother. He said the child was brought in due to the child disclosing to her mother that while she was in Mississippi in the care of her grandmother (Felicia) she was abusing her. Charlie said he was told that Makiyah has been in Chicago, IL with her mother for a week now due to the child’s aunt dropping her off with her mother. Charlie said to his understanding the child was randomly dropped off with her mother by her aunt due to Felicia no longer being able to care for the child. Charlie said the child’s mother told him that Makiyah was staying with Felicia in Mississippi until she got everything together for the child to be able to come and live with her. However, he said according to the child’s mother the child will be staying with her and will not be going back to stay with her grandmother.
R/s around November 05, 2014, Calli (8) was severely injured. R/s Calli had extensive bruising to her face, two black eyes, facial swallowing, and bruising to her jaw. The Forte’s (Roshonda and Reginald) have had the baby since she was one month. Reporter stated mom (Kimberly) and the Forte’s had a verbally and written custody agreement for the Forte’s to keep the child but they did not get the papers notarized. The father (James) would get the baby from the mother every other weekend while the Forte’s were keeping the child. PER REPORTER: When Phillip Jr. met Amanda, she was 6 months pregnant. Mom runs off all the time; she has left Amelia at the home. Amelia was born May 12th. Mom ran off on Phillip Jr. and got pregnant. She just had a little boy in December. Mom has been gone for about 3 months. Mom doesn't come see or get Amelia. The maternal grandmother works at Wal-Mart and wants nothing to do with mom and the child. Phillip Jr. has a good and has done nothing wrong. He has a disability. PER REPORTER: The father said he and the mother share custody of the child. There is no formal custody agreement. Report was recieved by police that the father was pulled over and the child was sitting in the father's lap. The father was arrested and charged with DUI of intoxicating liquor and endangering a child. An additional charge was failure to stop motor vehicle when an officer signals. Sherri was also in the vehicle. She said she was also under the influence and couldn't drive the vehicle. Sherri was released. The child was not harmed or hurt. With fault based divorce in the 1960s, child custody depended primarily on the child’s age. If the child was under seven years old, also known as the ‘tender years,’ the mother would receive physical custody. This was because of the belief at the time that women are good caregivers and it was their job to take care of the children at home. However, if the children were older, custody would be granted to the parent of the same sex. Sometimes judges would also award custody of children dependent on martial or sexual conduct of the spouses. When custody was awarded in this way, the presiding judge could be more focused on the rights of the parents than what is best for the child in that situation. Either way, it was quite noticeable that child custody was based on the judge and their opinion, which could change from case to case.
