Ms. Abigail Covington (“Ms. Covington”), a brewery owner, came into the firm’s office on September 12, 2016, at approximately 12:30 p.m. for an interview. The interview lasted approximately twenty minutes. The interview focused on the circumstances surrounding Ms. Covington’s dilemma and the relief she seeks. Notably, Ms. Covington wants to enjoin her former employee, Rebecca Hanson (“Rebecca”), from producing and selling Bad Ass Brew (“Bad Ass”). Bad Ass is a lager that is essentially identical in style, taste and appearance to Achy Breaky Winter Lager (“Achy Breaky”), which is a beer that Ms. Covington’s son, Matthew, created. As a result of the misappropriation of the Achy Breaky recipe, Ms. Covington’s brewery has suffered a dramatic loss in sales of virtually all of the beer it sells. Ms. Covington owns a family brewery that employs eight full-time employees and three part-time employees. The brewery sells three staple beers and experiments with different rotating beers throughout the year. Generally, Matthew uses the German Doppelbock brewing process, which has been around for centuries. Matthew consistently works with Chilaca chile peppers as an ingredient during the brewing process, which is a common practice in the industry. The Chilaca chile peppers are imported from Mexico and all of the employees know that Matthew uses the peppers in his experiments.
