After all, Microsoft holds a solid reputation in operating and security software shouldn’t they be able to produce a desirable phone? Our team believes it can. The cell phone industry is dynamic and thriving market that offers a place to innovation. Despite the losses already assumed by Microsoft which includes, assumed infringement liabilities by the purchase of the Nokia cell phone line, and the added expenses in the amount of $780 million under the Phone Hardware Restructuring Plan (SEC, 10Q dated 09/2016), our team feels Microsoft is in a good position to release a desirable and successful phone line. Last month, Microsoft unveiled the Microsoft Surface 2. The product is targeting users who prefer to use their tablet for work purposes over leisure with built in Microsoft software, high storage and durable battery. The emphasis that the Microsoft Surface 2 is a “tool not a toy” provides a clear idea that Microsoft is targeting professionals who are interested in productivity. Intellectual property is defined as an invention or work that is the result of creativity. A company may apply for a patent, copyright, or trademark to protect intellectual property. A patent is essentially a limited monopoly in which the patent holder is allotted the exclusive right to make, use, and sell the patented innovation for a limited period of time. Infringement of a patent is the unlawful making, using, or selling of the patented device within the territories of the United States, during the term of the patent. The five primary requirements for patentability are: patentable subject matter, utility, novelty, non-obviousness, and enablement. If a patent is infringed, the patent holder may sue for relief in the appropriate Federal court. The patent holder may ask the court for an injunction to preclude the persistent breach and may also ask the court for an award of damages. A question of my interest is are individuals becoming more attached to their cell phone? Cellphones in the past were more simple, where in the past would serve as a tool to use in case of an emergency, whether if it was to make a phone call if stranded somewhere or simply to make calls to family or friends. Now cell phones have evolved to have a multitude of uses now as they have the internet, different applications to meet the individual’s entertainment/needs (dating apps, school apps, news apps, social media apps, music apps, inspirational quotes apps, and exercise apps to name a few, and the list goes on), navigation, photo storage, and camera. Therefore, a person is always connected to social life and the world. What people use to only do from a laptop, is no longer the case. Cell phones, for the most part, have taken over laptops, computers, watching the news on TV/reading the newspaper, etc. It seems that cell phones are becoming more of a commodity, where individuals today, cannot seem to live without.
The beginning of the era of mobile technology started forty years ago with the first call from a cell phone. Martin Cooper, vice president of Motorola, walked out of a Manhattan building and made the first cellular network call from a DynaTAC phone. The first call was made to Bell Labs, Motorola’s largest competitor in the mobile marketing business. (Cheng, 2013) Cooper’s phone call started a trend in which technology constantly evolves. From the Motorola DynaTAC to the iPhone 5S, the mobile phone has evolved since the large, bulky device made in 1973.
However, two of the major manufacturers of mobile phones clearly think that there is potential value in using a low-cost strategy to sell phones. "Nokia and Microsoft on Monday announced plans to accelerate the sale of smartphones running Windows software by adding a cheaper version to their lineup and dramatically expanding the sales network around the world" (O'Brien 2012). The target market for these phones will be in the developing world. Although China and other areas of the Far East have shown brisk sales of Apple products, there is a large segment of the population not wealthy enough to buy premium-priced phones. Cellphones are used even more in the developing world than they are elsewhere, given the lack of stable landline communication systems or computers.
When Microsoft first started, Bill Gates originally had the position of having “a computer on every desk and in every home”. Since then, Microsoft has slowly shifted to becoming the dominate force in the technology industry. With the Surface, Microsoft have achieved this by making the brand’s positioning all about being productivity. For tech-users, the Surface is a tablet which provides all the power of a laptop unlike Apple’s iPad which only provides the power of a tablet.

While Microsoft has been planning on releasing a Surface phone for some time now, they have decided that they will not release this phone until early 2017 along with some other new Windows 10 devices. While many users were expecting to see the phone in the near future, many sources have stated that this is not the case. In fact, the new Surface phone may not be available for several months. This news may not be positive for users, but there are several things that they may look forward to, such as the possibility of three different models to choose from.
