A STUDY ON DELAY IN DISPOSAL OF CIVIL LITIGATION IN BANGLADESH PERSPECTIVE
Historical Background:- The age old adage ‘Justice delayed Justice denied’ has control significance for meeting the ends of justice. Delayed justice in the means of inflicting injustice through process of law. Speedy disposal of case is an important condition of ends of justice. The laws contained themselves to protection of the weak against the economically strong. The fisc against corruption, the ignorant against the knowledgeable and to assuring punishment to perpetrators of physical harm. “It is what every law code since has sought to accomplish; and it implicitly contains and absolute concepts of justice against which conduct can be measured.1

Today these assumption with which the code was enacted are no longer valid. There are a small number of competent judges and very few of them take pride in their work. Their integrity and honest in being questioned. The confidence in the administration of justice that the people have had is in the wane. The output of a judge has severely come down. The members of the bare are no longer well equipped with the law and particularly the relevant laws bearing on the case and precision in their submission in lacking. The honesty and integrity amongst the lawyers is in the lowest level. For almost every act from instituting a case to the delivery of the certified copy of the judgment or order one has to grease the palm of the court staff. Few of the judges make any effort to control the dairy as a result of which the bench officer exacts substantial amount of the money simply to place a case in the daily cause list. Once there was a row over the matter and there was serious altercation between a bench officer and a concerned lawyer but the learned chief justice without applying his mind to the problem put the blame on the lawyer when a litigant in jail custody is granted bail, the
