Abortion Should Be Legal In Canada

Abortion, the sound of the word can cause an environment to go from cheerful and relaxed to tens and edgy in seconds. Abortion is one of the major controversial topics of all time. Many consider abortion to be murder and criminal procedures should be brought forward, they consider it to be immoral and unethical regardless of the circumstances. They believe the reason why women exist is to bear and raise children; their body is only a host to the unborn child and should not be tempered with to enable the reproduction of other generation.

Abortion should be illegal in the United States of America. Since abortion was made legal in 1973, almost 57 million babies have been murdered by abortion. At the rate of 2,900 babies aborted a day, or 1,058,500 a year, the death toll is averaging almost double the deaths caused by the “leading cause of death” in the U.S., heart disease. These are 57 million people, who could've grown up to cure cancer, or found a reliable and abundant clean source of energy. Also, women who have had abortions almost always are psychologically affected in some form or another. These affects include, but are not limited to; regret, anger, guilt, shame, sense of loneliness or isolation, anxiety and depression, and suicidal thoughts or feelings/actions. In fact,

Women should not be able to make decisions about how to live their lives. Clearly, by the looks of the statistics, with approximately 42 million abortions a year, women are foolish. Women should not have the option of deciding when or whether to have children. They do this by making choices regarding when to have sexual intercourse and what contraceptive methods to use. The government should have all the power to make these decisions. Abortion reflects a women's value, her family, and her career.

It is not fair that the child has no say in this because he/she can not communicate with the outside world and even if he/she were to do so, they would never get a chance. The act of an abortion totally contradicts Canada’s legal rights that Everyone has the right to life… not to be subjected to any cruel and unusual treatment or punishment (canadian charter of rights). An unborn child should not receive any kind of cruel treatment, in this case death. Right now, thousands of children around the world are in a live or die situation, in which their mother decides whether to keep or to terminate them. There are multiple issues that Pro-Life and Pro-Choice argue about constantly trying to justify if abortion should be legal or Illegal. While the mother has rights, the fetus also has rights.

The topic of abortion is quite a controversial one, many people are both for and against the motion: “Should abortion be legal in the U.S.?”. The main arguments for this topic are “You are taking a child’s life when aborting.” but others may say “Women deserve the right to their own health decisions.” Many people are also in the grey spot with this topic, many believe under certain circumstances such as medical complications, that abortion should be legal.

Abortion should be legal, because there are too many things that go wrong. A women could be raped and need to get one because she doesn’t want to look at the child and doesn’t want to feel it grow, freedom of choosing what to do and how government involvement in personal decisions such as this could lead to potentially having the government deem how many children you can have or even how many pregnancies you are allowed, medical reasons for abortion, and the ability of a woman to have control of her body is critical to civil rights.

In the 19th century, after tremendous progress in surgical processes, abortions were then conducted by surgeons on a wide scale, while medical abortions are used concurrently. However, as abortion technology prospers, legal restrictions came with it. In 1803, a English statute abolished the previously-legal first trimester abortions. The act “condemned the willful, malicious, and unlawful use of any medical substance when used with the intent to induce abortion” (Stern, 1968). In 1821, Connecticut enabled the first statute in the United States regulating abortions. Within 10 years, states like Illinois, Ohio, New York, Alabama, and others enabled abortion restriction statutes, and by 1968, 50 of the 51 jurisdictions in the United States have prohibited abortion except in the case women’s life is endangered (Ibid., at 3). In 1965, Britain, however, legalized abortion for “medical conditions of the mother, for socio-economic reasons, for eugenic considerations, and for pregnancies which resulted from rape or incestuous intercourse”, which is still law today (Ibid, at 4). In Canada, abortion has been legalized since 1969 through Bill C-150 if “a committee of three physicians determined that the pregnancy was a threat to the woman's life or health” (Norman, 2012). In 1988, Canadian Supreme Court struck down bill C-150’s provision requiring committee approval to receive an abortion in its decision R v Morgentaler, legalizing abortion across Canada for any reasons (Ibid.).

As in other countries, Abortion was once illegal in Canada, and only allowed to be performed on the criminal law principle of necessity to save the life of the pregnant woman. When it comes to 1988, however, Supreme Court of Canada has decriminalised the abortion law since Section 251 (the law regarding to abortion) violated Section 7 of the Canadian Chart of Rights and Freedom, which guarantees the right to live, liberty, and security of the person. Therefore, it is now permitted in Canada for a woman to have an abortion for any reasons which she desires.

Since Parliament has jurisdiction to protect the child within the womb, it cannot make abortion a right. However, the fact that this was matter was taken to Canada’s highest court, and 5-2 decision was made is slowly leading to more freedom of their own body for women.

Two people come into play, pro-life and pro-choice supporters. If someone is pro-life, they don’t agree with abortions. Global overpopulation is an extremely broad topic that represents exactly what one would think, the overpopulation of the entire globe. Though global overpopulation is broad topic, there are many key factors that aid in the increasing total population. Some factors are more effective than others, but the most altering factor is the percentage of fertility. The direct connection between reducing the population is through pregnancy rates. There are multiple ways that a women’s pregnancy rate could be significantly reduced, by the use of birth control. Including the possible results, if a solution is not discovered and the population numbers continue to grow.
