Statement of the Problem
Introduction
Victor Marie Hugo (1831) once said, “He who opens a school door, closes a prison.” Such a brilliant reflection from this French poet and dramatist explored an astounding reality of life with one of his best-known works, Les Miserables (1862). In this play, Jean Valjean is a prisoner on parole who created a new life for himself with a great deal of time spent exploring the decision that changed his life (Hugo, 2015).
Each year, thousands of adults all in the United States go to prison for crimes that may both minor and atrocious. Almost as many incarcerated adults will leave their prison walls to be once again reunited with families and communities that they left behind. While there are some stories of successful reintegration into families and communities, many others fail and end up being re-incarcerated, a process known as recidivism.
Although there are different factors and accounts for why some ex-prisoners succeed and some do not, it is highly believed that a lack of education and serviceable skills that are necessary to the process of prison reduction is one essential element.
At present, the federal government and county officials are facing a crisis with their criminal justice systems due to increases in the amount of prisoners and less money being relegated to their upkeep. The problem with prison reentry has been going on for many years in the United States, as I discussed in assignments one and two. Recidivism issues can often be linked with reentry issues because when offenders are returning to society, they need to be prepared, which is something that our current criminal justice system is not trying to achieve. In order to create some defensible solutions for prison reentry and the recidivism issues linked to prison reentry, the criminal justice system has to realize that there is no one overall solution because every offender have different offenses, different stories, different outcomes, and different prison sentences. During the past decade, there has been a newly found interest in prisoner reentry. This is due to a change in many of the factors surrounding the release of convicted felons and their reentry into to the community (Visher, C. A., & Travis, J. 2003). The number of people incarcerated in the United States prisons has quintupled and correctional facilities are working on getting them back into the community. Over half of the convicted felons that are released from prison return to correctional systems within one year of their release date. In the United States, each day approximately 1,600 adults are released from state and federal penitentiaries to reintegrate back into the community (Gunnison & Helfgott, 2013). Reentry programs have been created all over the nation to help offenders successfully transition from prison into society. Offenders are confronted with numerous obstacles when attempting to reintegrate back into society. Ninety-five percent of offenders are released to reintegrate back into the community (Davis, Bahr, & Ward, 2013). Upon release, ex-offenders realize that despite the fact that they are no longer incarcerated, they face many restrictions. The restorative justice development rose to address the disappointment of the criminal justice framework to manage victims, offenders, and communities in an integrated way. A core focus of this development has been to expand the role of the community in advocating changes that will avert the issues and conditions related with crime and the demand for a criminal justice intervention (Hass & Saxon, 2012).
Standing as one the most dominant agencies operating within the criminal justice system, the Federal Bureau of Prisons is a detrimental factor that has proven to materialize the very aspects of which to expand the dynamics of maintaining care, control, and custody of federal inmates. Albeit as it may that the agency’s establishment fails to loom too far into the crevices of history, the Federal Bureau of Prisons has surpassed a multitude of platforms that has propelled its strengths today far beyond what its founders could have imagined. In the past four decades, there has been a staggering increase in the United States prison population at the local and state level. Currently there are 2.2 million people in the nation’s prisons and jails that has added up to a 500% increase over 40 years (The sentencing project). The cause of this prison growth is a variety of laws and punitive sentencing policies that were initiated starting in the early 1970’s. Policies such as harsh drug penalties for non-violent crimes, Mandatory Minimum Maximum sentences and the Three Strikes law have all contributed to America’s current problem of mass incarceration.
In the 1970s and 1980s, a massive amount of inmates began fillin up the United States prison systems. This huge rate of growth in this short amount of time, has greatly contributed to the prison overcrowding that the United States faces today. In fact, the prisons are still filled to the seams. This enormous flood of inmates has made it practically impossible for prison officials to keep up with their facilities and supervise their inmates. Many criminals are sent to jail on a day to day basis. Once they have completed their sentence they are faced with many problems once they are “free”. These problems can be but are not limited to housing, employment, and substance abuse. The prisoner, once they are released, has a tendency to go back to their old ways and to continue the life of crime they were a part of prior to prison. To avoid this, while a prisoner is in prison, the staff creates a reentry program for the prisoner. The reentry program takes affect once the prisoner leaves prison. Congress has steadily expanded the size and scope of the federal criminal code since the 1980’s. During this time, the federal prison population has explored and caused serious strains on federal finances and resources. Since the 1980’s, the federal government added approximately 2,000 new crimes to the criminal code. The federal imprisonment rate has grown by 500 percent and annual spending on the federal prison system increased almost 600 percent. During the 1980’s, the federal prison system cost around $970 million to operate, but today costs billions of dollars. With the dramatic increase in the prison population since the 1970’s, the number of people released from prison has also seen a steady increase. In 2009, almost 730,000 people were released from state and federal prisons, an increase of more than 20 percent since 2000. Those newly released are often condemned by their time in prison and usually have to deal with a loss of social standing. The transitioning process can present various challenges for them including but not limited to reconnecting with family and peers, finding living arrangements and employment. This transitioning process is better referred to as reentry. Reentry is the process in which individuals return to communities from prison or jail custody, with the goal of reintegrating into society. In addition to feelings of fear, anxiety and uncertainty, this process can be further complicated by the many indirect legal consequences of a criminal conviction, sometimes called collateral consequences, which can inhibit an individual's ability to reenter society.
All humans have different morals that change based on their environment and circumstance. Jean Valjean, in the novel Les Miserables(1961), changes from someone with confused morals to a man with more morals than most whom with respect learns to love and share.
Adjusting to life after incarceration can be a very long and difficult process to overcome. There are many obstacles people face when returning home for the first time in years. Most people generally come home to nothing and have to try to make a life out of it. As an ex-con you face stigma, lack of opportunities and the constant risk of recidivism. Recidivism is the ongoing cycle of incarceration. You continue to be in and out of prison because you cannot successfully re-transition into society. This topic is worth investigating because recidivism is a current problem in the United States and it usually takes place because the justice system fails to prepare their inmates for what life will be like. Rehabilitation is key and because there is a lack of that there is a lack of success in offenders returning home. Young adults should be aware of recidivism because they can easily be sucked into the system and this can happen to them. They can find themselves in a position where they end up in prison and fall victim to recidivism. Questions that will guide this research include:

In America’s tough economic society, over population has become an exceedingly hot topic issue. However, overcrowding in America’s prison system has been a severe problem since the 1970's. The majority of the changes have come from different policies on what demographic to imprison and for what reason. The perspective of locking up criminals because they are "evil" is what spawned this (Allen, 2008). Because of this perspective the prison system in America is in need of serious reorganization. Since 1980, most states have one or more of their prisons or the entire system under orders from the federal courts to maintain minimum constitutional standards (Stewart, 2006).
Similarly, another critic believes that the morals and peer pressure of a dauntless society are what causes Man to become evil. This evil slowly forces them to progress into “hardened ruffians” that are forced to resort to a pis aller in order to regain some hope for themselves. Thus, society cannot evolve (Lewes 245). Contrary to what Reeves believes, Critic Moss believes that misfortune is the sole cause of one’s faults and that the main theme of the novel is the barrier between “those who choose degradation and those who are driven to it” (228). Furthermore, the critic Napierkowski believes that the meaning of life is love and that through the love that all people receive, any number of traits can be changed. She explicates that change is extremely relevant in the case of Jean Valjean who is a convict turned upstanding citizen. She also recalls that in the novel Valjean is only transformed due to the love he receives from the Bishop of Digne, who gave Valjean everything that he had (Novels for Students). Reeves, again, also explores the concept that Hugo is trying to prove that humans need to love each other for the world to be a happier place (Masterplots). Thus, through evidence in Les Misérables, the aforementioned themes can easily be proven.
