The Moral Obligations Owed Towards Nonhuman Animals

The biggest debate pertaining to the ethical treatment of animals is whether or not they are moral agents and if they are deserving of moral consideration. Many humans believe, in order to say a being is deserving of moral consideration, is to say that this being is able to recognize such actions out of moral consideration. In the minds of the majority, humans are thought to be the only beings able to recognize such actions out of moral consideration and the only beings capable to respond to such actions (Gruen, 1). Applicable to animals, their interests are what they desire or what they prefer. These interests may not be considered rights, but shall be protected by such. Would it not be desired or preferred of animals to live free from pain and suffering? Philosopher, Gaverick Matheny, believed in a utilitarianism view pertaining to the ethical treatment of animals. The ethical theory of utilitarianism states, “act in such a way as to maximize the expected satisfaction of interests in the world, equally considered,” (Timmons, 384). This utilitarianism perspective reinstates such humans need to act in ways, not only as to maximize the expected gratification of other human beings, but in ways to maximize the expected gratification of every being in the world, including nonhuman animals. According to Matheny, many nonhuman animals are capable of sentience, the ability to feel pain or pleasure as well as experience subjectivity (Timmons, 755). Seeing as Matheny declares nonhuman animals as sentient beings, he states it is justifiable for humans to act in ways to respect their interests, as stated in the theory of utilitarianism. On the contrary, animals are subjects of a life, therefore; they are entitled to rights and moral considerations, just as humans are entitled to rights and moral considerations. Although they cannot express their feelings as strongly as humans, animals are fully capable of pain and suffering. Despite the fact animal rights are weaker in strength and content, this does not establish they should be abandoned of rights altogether. It is typically burdensome for some humans to set aside their beliefs in that animals are necessary solely for the good of humanity. These individuals should realize, if in cases where animals are absolutely demanded for survival of humanity, it is of moral obligation to ensure they be treated in the most optimal humane aspects. Animals are deserving of their rights to entail them of a pleasurable life, free from pain. Although they cannot be considered moral agents, treating animals less than deserving of moral consideration, as well as denying them of their rights, is truly erroneous. Is it ethical for animals to have the same rights as humans? During this paper I will present the views of both sides. I will try my best to give the reader a chance to come to there own unbiased conclusion. I will talk about the key areas of animal ethics. I will present the facts and reasoning behind the arguments over Animal cruelty, testing, hunting, and improper housing. My conclusion will hopefully bring us closer to answering many of the question surrounding “Animal Rights and Ethics”.
I am going to argue in support of Peter Singer’s claims against speciesism. It is right to claim that human suffering and animal suffering should be given equal considerations. Both humans and nonhuman species suffer both physically and emotionally and both deserve equal considerations on the basis of morality.
A highly popularized and debated topic in our modern society is the promotion of animal equality or animal rights. Many people, philosophers included, have a wide range of opinions on this topic. Two of the philosophers studied in class who discussed animal rights were Peter Singer and Carl Cohen. Singer, who has the more extreme view on animal rights, believes that all animals are equal and that the limit of sentience is the only defensible boundary of concern for the interest of others (Singer, 171). While Cohen, who’s view is more moderate than that of Singer’s, believes that animals do not have rights, stating that to have rights one must contain the ability for free moral judgment. The question of the correct ethical treatment of animals has been a topic of many heated debates. The basis of this discussion arises numerous premises that justifies the treatment of animals. Whether animal do in fact have a sentient? And what is distinctive about humanity such that humans are thought to have moral status and non-human do not? Providing an answer to the correct ethical treatment of animals has become increasingly paramount among society as well as philosophers.
Throughout history, humans have utilized nonhuman animals for the benefit of mankind. This tendency increased as civilization developed, and presently, necessitated by staggering population growth and technological progress, human use of animals has skyrocketed. We eat them, we breed them, we use them as test subjects. Some people have begun to question the ethics of it all, sparking a debate on animal treatment and whether or not they have rights. In a paper on the subject, Carl Cohen lays out his definition of rights, explains their relationship with obligations, and uses these ideas to present the argument that manifests clearly in his piece’s title, “Why Animals Have No Rights”. “Nearly as many, 68 percent, were concerned or very concerned about the well-being of animals used in ‘sports’ or contests as well as animals in laboratories (67 percent) (Kretzer, 1).” Many people question whether an animal is capable of thought and emotions. Others feel as though animals are the equivalent of humans and should be treated as such. Since the 1800’s, animal rights has been a topic that has several different sides including two extremes. If animals can react to their environment, emote, and are aware of things done to or with them, then they should have similar rights to humans.

In Stanley Benn’s “Egalitarianism and Equal Consideration of Interests”, it is explained that animals and human imbeciles are distinguished not because of fundamental inequality, but solely on the basis that the two subjects are of different species. In regard to animals’ moral rights and the infringement of those rights due to the practice of speciesism, Singer employs a utilitarian style of argument to defend animals’ moral rights; in short, the interests of each being which is involved should be taken into consideration and said interests should be given the same weight as that of another being. Throughout history morality has been a topic of intense debate. Innumerable thinkers have devoted immense amounts of time and energy to the formulation of various ethical theories intended to assist humans in their daily lives. These theories set out guidelines which help to determine the rightness or wrongness of any given action and can therefore illuminate which choice would be morally beneficial. And while many of these theories differ substantially, most have at least one common underlying principle, namely that humans deserve to be treated with a certain level of respect. In his article “All Animals Are Equal,” Peter Singer discusses the widely-held belief that, generally speaking, there is no more inequality in the world, because all groups of formerly oppressed humans are now liberated. However, it often goes without notice that there are groups of nonhuman animals that continue to face unequal treatment, such as those that are consumed or used as scientific test subjects. Singer’s article criticizes the belief that because humans are generally more intelligent than nonhuman animals, then all humans are superior to all nonhuman animals. In the essay, “Nonhuman Animal Rights: Sorely Neglected,” author Tom Regan asserts that animals have rights based upon inherent value of experiencing subjects of a life. Regan’s argument will first be expressed, later explained, and evaluated in further detail. Lastly, that fact that Regan thinks rights are harbored under the circumstance of being an experiencing subject of a life will also be discussed in terms of the incapacitated, etc.
