Argumentative Analysis of the Essay “First Amendment Junkie” by Susan Jacoby
What is a First Amendment Junkie? According to author Susan Jacoby, censorship of any form is wrong. From the beginning of Jacoby’s essay, “First Amendment Junkie,” it’s obvious where she stands on the topic.
Jacoby states that the people who most support the censorship of pornography are women. These women are often self-proclaimed feminists who ironically support the First Amendment. While criticizing the production of pornography, these feminists attempt to argue that “mainstream” pornography is no different than child porn.

If pornography is censored because it offends certain people, then what about religion, or even sexual orientation? Sure, gay marriage has recently been legalized, but there are some people in this country who find it just as offensive and obscene as some people find pornography. Are we as a country supposed to satisfy the sensibilities of one group of people (i.e.: self-proclaimed feminists, in this case) simply because something bothers them or are we right to allow the freedom of expression that pornography claims to be to keep in ordinance with the First Amendment?
And what about fictional characters such as Santa Claus and the Easter Bunny which is offensive to the Christian community? Or those who protest being forced to say the Pledge of Allegiance in schools? Are these people considered less patriotic and should they too be stripped of their First Amendment rights?
It’s impossible to censor all disagreeable sides because all that would be left is a bland “politically correct” society and that’s an unattainable goal because it’s not possible to please everyone. In the end, there will always be someone who disagrees with someone else about something and they will indeed use their First Amendment right to free speech to voice these grievances.
As per her written essay, Jacoby is “First Amendment junkie,”
When considering situations where censorship is necessary, it is important to analyze who might need protection. Often, children need to have the material they watch censored, because they themselves cannot distinguish how raw the material they are watching is. We need to protect our youth, as well as people of all other ages from that kind of raw material. It is possible that the material could be something of the hating nature. I believe that even though hate speech is not a possitive use of free speech, it is a right that is everyone's to practice. The First Amendment rights have caused much controversy because it allows people to say, act, or feel how they see fit; for example, hanging of a Confederate flag or displaying a swastika in public view. It is a very hard and intense act; although it is their right to do so. According to the Supreme Court’s ruling, the displaying of these symbols is protected under the First Amendment.
The First Amendment guarantees freedom of religion. This is a part that is often taken away from individuals. A frightening but clear example of this was the Holocaust. Million of Jews were forced to hide their religion and to be ashamed because of one man that though it wasn't the right way to live. The U.S. Constitutions makes it so that this will never occur in The United States. Another example that shows breaching and use of two different sections of the constitution is the KKK. This organization commits crimes and puts down certain people just because of their religion. These people are making it so that some would not want to show their heritage and what they believe because they are scared of ridicule. The KKK although violent and seemingly evil actually uses The First Amendment every time they meet. Some hate the KKK but it is their right to organize and say what they feel. No one can stop them from saying what they think of a certain religion. Some feel that there should be limitation on freedom of speech but then would our country truly be free? The first Amendment of the United States Constitution says; “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”[1] Our fore fathers felt that this statement was plain enough for all to understand, however quite often the United States government deems it necessary to make laws to better define those rights that are stated in the Constitution. As of right now, there are 27 US amendments with all kinds of rules. But I’m only going to talk about the main 10. Some may be outdated and need to be updated while others after 241 years still work in this modern world. Who knows maybe after 100 or 200 years some of the amendments will stay the same with no updates or tweaks.
One of our civil liberties is the First Amendment. The First Amendment states (Amar and Adams)“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press, or the right of the people to peaceably assemble, and to petition the Government for a redress of grievances.”. Freedoms granted under the First Amendment often come under fire and should be protected from proponents who try to undermine the very liberties it protects.
As US citizens, we should be appalled that such practices are allowed. Not only are we deprived of rights, but we are subjected to the control of others. If I choose to go home and turn on my TV to see a half-clad woman and hear frequent vulgarities, then by all means, I, as a citizen of this free country, should be allowed to do so. Who is to determine what is “degenerate” or “depraved”? What should qualify a person to become a censor?

Often times I am in complete disagreement with what is being said, but I realize others have just as much right as me to share their thoughts and opinions. If they are stifled, I will be also.
Does the 1st amendment protect their freedom of speech? Again, absolutely and resoundingly, yes. John Denver stated this eloquently, saying that suppression should not be tolerated in society and censorship is the first step to suppression; he continues on likening it to Nazi Germany; which banned and burned books.
There are always two sides to anything and these are the two sides of the First Amendment. The first side, Side A is some believe that social media should censor what we show to everybody because everybody may be shocked by it. Another side, Side B is some people believe that social media shouldn’t censor what we post because people should accept how in the world it isn’t
Censorship may be protection from inappropriate materials, but it also limits free speech. For the limitation of free speech, it is reasonable why people are emphatically against censorship. It is understood that there is a need to filter some of the materials released in today’s society, but too much is being done by people who have no right meddling with everyone’s rights. Ethics Pornography is a social problem and is a commodity brought into existence by certain characteristics of a highly developed civilization. The problem with pornography is that any form of censorship or downplay cannot solve it. It is difficult to draw the line between ones right to express their ideas and or opinions or sexuality
As always, there are those individuals that oppose the power to censor. There are members of society that believe in the freedom to speak publicly and to publish. This is a basic belief in the freedom of expression and is to be protected by the First Amendment to the Constitution. On the eve of the bicentennial of the Bill of Rights, the first wave of a nationwide survey, comprising more than 1500 citizens was conducted. Through this survey it was found that American rate free speech as their second most precious First Amendment right and regard a free press highly in the abstract. The Constitution guarantees us the right to Freedom of Speech. Nowhere in the First Amendment does it state that we have the right to freedom of speech as long as everyone agrees with us and likes what we say. Quite the contrary, it states that “Congress shall pass no laws abridging our right to freedom of speech.” Censorship does exactly that, severs away our right to freedom of speech. Censorship is Government telling us what we are to approve of and disapprove of. It is Government abridging our right to freedom of speech.
