Should the United States government be allowed to seize property from you without any explanation or compensation? That is a question many people in the U.S. are asking themselves today. Eminent domain should not be allowed in the United States for several reasons. People own buildings that they do not want destroyed because they are family dwellings or places of business. People have money invested in the buildings and the property they sit on and do not feel it is right to lose it to the government. There are also the property owners who want to protect their property because it has been handed down in their family for many generations.

The basis of criminal justice in the United States is one founded on both the rights of the individual and the democratic order of the people. Evinced through the myriad forms whereby liberty and equity marry into the mores of society to form the ethos of a people. However, these two systems of justice are rife with conflicts too. With the challenges of determining prevailing worth in public order and individual rights coming down to the best service of justice for society. Bearing a perpetual eye to their manifestations by the truth of how "the trade-off between freedom and security, so often proposed so seductively, very often leads to the loss of both" (Hitchens, 2003, para. 5).

These days there have been many issues surrounding the topic of private property and eminent domain. I feel that eminent domain is a good way to keep the needs of the community and each person’s individual property rights balanced. Even though I believe individual property rights are more important that the needs of the community, I also believe the government sometimes has to take that property away for the better good of the community. At the same time I also understand how people feel when they talk about “NIMBY” (not in my back yard), and also about their personal needs.

During this year of 1794, we have come through many tribulations and have suffered to great extent for our freedom of Britain. This country has lost fathers and sons to bring us freedom and ensure our rights are kept. It brings me displeasure to write about grievances with our own government. However we must be aware of current and past issues and let it be known that this country and government will defend its people’s rights and preserve their freedom.

The First Amendment one that is watered down, serves as example of the freedom we as Americans have. It is best known as the amendment that lets us say what we want when we want. There is more to it that gets overlooked. It blocks government from establishing a theocracy, grants the people the right to peacefully assemble and protest the government for a redress of grievances. Our press is independent and is given freedom to publish at will. Our freedoms embolden us to speak out and organize for progress and against society's wrongs. Sometimes groups will organize to speak out but will sink to extreme measures as a means of expression. The Bill of Rights is one of the most important things in the American government .The Bill of Rights has 10 Amendments. The fifth one however is one of the important one. The fifth Amendment deals with police procedures. Along with basic Constitutional limits, or in other words guidelines that Congress has to follow. The Fifth Amendment is a one of the most important Amendments because it gives people the rights to speech and privacy, the fifth doesn’t let people be charged with the same felony twice, and it gives citizens the right to a fair trial.

From the beginning, the United States Constitution has guaranteed the American people civil liberties. These liberties have given citizens rights to speak, believe, and act freely. The Constitution grants citizens the courage to express their mind about something they believe is immoral or unjust. The question is, how far are citizens willing to extend the meanings of these liberties? Some people believe that American citizens take advantage of their civil liberties, harming those around them. On the contrary, many other people feel that civil liberties are necessary tools to fight for their Constitutional rights.

The ideology behind what private property represents and conveys through the theories of both Locke and Marx's results in contrasting views. Locke heavily stresses the blending of labor and common land to create private property to increase one’s wealth. Liberty and livelihood under Locke’s theory is tied to the ability of an individual to control the use of their private property. Marx’s theory strongly contends that the bourgeoisie has gained control of the profit making private properties leaving the working class in a stage of exploitation. First and foremost, I am a proponent of Negative Liberty. Not only does this mean that individuals should be free from external impediments to action by other people, but also that a government should primarily remove obstructions to our freedom, which is in contrast to Positive Liberty, for the purpose of preserving individual liberties. The lack of hindrance to human action will limit government activities and create a free, tolerant society. In addition, Negative Liberty supports the individual freedom of choice and movement. With this in mind, I cannot help but emphasize the significance of the degree to which individuals encounter interferences from others. Some may argue that a government should actively create conditions necessary for self-determination and freedom to act in the presence of internal capacities; however, I interpret that as a sense of entitlement that requires a redistribution of wealth and ultimately violates the human right of private property. For this reason, I find Positive Liberty to be an infringement of others’ liberty. Throughout mankind’s history, there have been many types of oppression that illustrate my support for Negative Liberty, such as the exploitative authoritarian regimes, economic hardships, and racial oppression.

     The perception of liberty has been an issue that has bewildered the human race for a long time. It seems with every aspiring leader comes a new definition of liberty, some more realistic than others. We have seen, though, that some tend to have a grasp of what true liberty is. One of these scholars was the English philosopher and economist J.S. Mill. Mill's On Liberty provided a great example of what, in his opinion, liberty is and how it is to be protected. In this essay we will examine Mill's ideals concerning liberty and point out a few things he may not have been realistic about.
