An Arthur hearing is a two-stage process, with the first stage being the topic of this discussion post. In order to determine bail in capital and life cases, the burden of proof is greater than that required for trial meaning the proof of guilt must be evident or the presumption great. According to the article “evident” is synonymous with “manifest” which is defined as “put beyond question of doubt”. Therefore, I find that the evidence required for bail purposes must be such that there is no room for argument.
