As President of the college, I would utilize the bureaucratic, democratic, political, and ethical approaches in resolving the issue is this case study. It is very important that as the administrator of the college that this matter is handled diplomatically. The bureaucratic approach would entail using existing rules and regulations at the college to take the appropriate course of action. The democratic approach would allow key personnel and stakeholders to come together to discuss and recommend legal action for the institution, and how to proceed with the investigation. The political approach would be necessary because it is significant in how these allegations are handled and how it can affect the entire organization. The ethical approach
At a public high school assembly of roughly 600 high school students, Matthew Fraser made a speech nominating a fellow student for elective office. Fraser had discussed the subject matter of his speech before the assembly to two teachers. Fraser’s teachers had informed Fraser that the speech should not be delivered because the speech was inappropriate and that it could lead to severe consequences. In his speech, Fraser used what some students believed was a graphic sexual image to promote the candidacy of Fraser’s friend. Bethel High School had a disciplinary code that enforced a rule prohibiting conduct that substantially interfered with the educational process
Confront the students based on his actions and get an explanation as well as advise this will not be tolerated.
According to news reports, three teachers and an assistant principal in this district participated in activities that ranged from physically hurting students, cursing in front of students, and abusing paid leave time. Each of the employees involved was suspended for 30 days. Overall, the actions that the administrator and teachers partook in negatively impacted students and showed little regard for upholding the professionalism of education.
The two major ethical considerations that are important to address are 9.02 - Use of Assessments and 9.06 - Interpreting Assessment Results. 9.02 - Use of Assessments is particularly important because the psychologist must consider the individual’s language preference and competence. As was noted in the initial case description, Brandon’s parents are both Polish immigrants, and Brandon spoke Polish in home until he attended junior kindergarten. Although he may not have an accent, his language preference should be noted as English may not be the language he is more comfortable using. 9.06 - Interpreting Assessment Results should also be considered. Brandon’s test-taking abilities should be highlighted, as he is suspicious and ambivalent towards the psychological testing. These feelings may negatively affect his test scores, as he may try to either hide how he truly feels, or lie to make himself seem better or worse. It should also be noted that there could be other client characteristics that affect his scores as well, particularly cultural factors.
The method of ethical decision making which was developed by Dr. Cathryn A. Baird presented two components contained in all ethical decisions which are; The Four ethical Lenses and the 4+1 Decision process. The Four Ethical Lenses issue claims that different ethical theories and the means in which we tend to approach the situations which form part of our ethical traditions are looked at in four different perspectives. From each perspective there are different values on which to decide whether the action taken is either ethical or not and each lens also lays emphasis on determining whether the decision made is of ethical requirement. As student affair professional its important that you understand your student body and issues that may affect them. This admistration did not do much to stop the issues on the campus. The administration should have notifted the cousleing center and spoke who students who are expereinng racial issues. The cousling center which is apart of the Division of Student Affairs, can reach out to these students and provide them with different lectures, notes, and one on one time to express their views.
In 2011, the Office for Civil Rights issued “Dear Colleague Letter” which aims to clarify case reporting, provide resources for administrators and victims, and better explain the role universities play in the case process (Rammell, 2014). Another step in resolving the issue of Title IX compliance is a document recently issued by the Office for Civil Rights. In this document, the U.S. Department of Education’s Office for Civil Rights (2014) answers questions and further educates college and university administrators on correct Title IX compliance. NASPA also reviewed this document and commended it as breakthrough document that will work to better prevent sexual discrimination and respond to Title IX cases (Smith, Sun, & Sponsler, 2014). In addition to NASPA’s stamp of approval, the Association for Student Conduct Administration (“Student Conduct Administration,” 2014) recently issued a White Paper on Title IX compliance that details student conduct best practices, resolution methods, and ways to best cater these methods to various institution types. The main focus of this assignment is to examine the ethical, legal and professional frameworks, along with interprofessional collaboration in the provision of postoperative care to a gentleman who was refusing observations and how this influences and shapes professional practice.
In relation to the management of conflict the College has several inter-related procedures. The first and most important to this area is the Anti-Harassment procedure. This procedure deals with the steps, first informal and then formal, that a member of staff who feels they are being harassed can go down to resolve this conflict. Linked to this is the Disciplinary procedure under which action may be taken upon a successful Anti-Harassment complaint. For managers there is also the Poor Performance procedure should the conflict be in relation to the performance of a staff member. For conflicts in relation to employment matters, pay and grading issues the College has a Grievance procedure.
None of the Penn State staff who learned of the suspected abuse chose to contact the police or even investigate the claims for themselves. As a result of that, countless victims were affected. The decision to ignore the events that had transpired was an attempt to not tarnish the school’s name and to protect the higher officials from the negative consequences that may have arisen.
In a studied conducted over 236 american colleges shows 40% of them haven’t investigated a sexual assault in five years. Note that the survey does not include how many schools have had sexual assault reported. When schools do investigate it is done so by holding disciplinary hearings where teachers and students make up the jury most with little experience in handling sexual assault cases (Ganim and Black, 2015). This disciplinary our often task with the important question; Should the accused be expelled and potentially unfairly end a college education? The lack of law in order in these meetings have been met with frustration from the victims and most recently the accused. The law allows school to make their own rules on how they handle such cases and many schools have different way of investigating the crime. Some schools allow lawyers other don’t, some will allow students to handle cases but some won’t. The lack of a uniformed and organized due process is one of many reasons where the victims won’t come forward with the fear of having the odds stacked against
Recognize moral issue: The issues in Fresh Taste NZ Ltd. are rude behaviour of employer with employees, ignorance of basic ethical practices by workers and providing less salary to the workers etc. All these things create ethical disputes at workplace.
The incident in question has placed me in a unique opportunity; as the facilitator of this situation would be best to approach this in a manner that would best benefit the organization, including my department. Although I am already conflicting within with personal and professional points of views, addressing the situation will become a challenge. Despite who initiated this situation or who escalated the situation, resolution must be determined in the best interest of communication within our environment.
