I propose to you a case study on a pre-kindergarten English language learning student through qualitative research. My goal was to find out if he faces any problems with regards to his behavior, academic progress and attitudes towards his teachers, classmates and parents. His name is David and just recently came to the United States from Russia about two years ago. He has a complicated time understanding what goes on in his environment because of the language barrier. The one positive aspect for David is that my assistant in the class is Russian as well. Even though he has a hardship speaking the English language and understanding his peers, my assistant helps translate words from Russian to English for him and vice versa.
Over the last decade or so, important legislation has been implemented to positively ensure fair and equal access to a quality education for English Language Learners (ELL). Change did not happen without there being obstacles to overcome. There were many overturned cases that initially sought to strip English Language Learners of their basic rights to an education. Yet, there would eventually be legislation instituted to help alter the course.

Communication is a two way process which allows us to express our thoughts and feelings to others, while allowing us in turn to understand what others are trying to convey to us. Communication involves speech and language (verbal) as well as facial expression, gesture and body language (non-verbal). Communication is an essential life skill for children and young people and it underpins their social, emotional and educational development. (Bercow 2008)

Over the years, many schools have grown increasingly with diversity. As teachers, we must be aware of the many different students we will have in the classroom. This means that all our students will learn at different rates, take in new information differently, and overall have a different perspective on certain topics. With so much diversity in the school system, education policies for students who are English Language Learners (ELL) have greatly emerged. Many individuals move to the United States for better opportunities or to ensure their children obtain an education. With such a growing number of people entering the United States each day, emerging laws and cases must aim to support English Language Learners to ensure a fair and equal education for everyone.
Language is an art form through which shapes our understanding of ourselves and our world. (BOSTES, 2012). It is through language; where human beings are able express their inner thoughts and emotions. Language is defined as the verbal behaviour; gestures, body movement (Pierce & Eplin, 1999). The NSW K-10 English Syllabus emphasises that language is central to the intellectual, social, and emotional development of all students and that the model of language development is through a sociolinguistic approach. Sociolinguistics is referred to as the study of language and its relationship with culture and society (Kennedy, 2014). Sociolinguistics is an approach through which correlates with the NSW K-10 English Syllabus, as learning English, is recursive and develops through ever-widening contexts (BOSTES, 2012). It is through English, where students develop their critical and imaginative faculties to broaden their capacity for cultural understanding. (BOSTES, 2012). Through the syllabus (the rationale, aims, objectives, outcomes, stage statements and content), is the notion of how students will develop an appreciation of language as well as the skills in composing, understanding values and attitudes. Thus, the study of English, as expressed in the syllabus, allows students to learn across the curriculum as well as develop an understanding about and dress contemporary issues they face (BOSTES, 2012).
