On December 2nd, 2015 at approximately 1540 hours I, Investigator James Poffel was contact by Officer Jason Steele in reference to a possible child sexual abuse report he was being dispatched to at the Children’s Clinic. Officer Steele contacted me to inform me that they had a victim at the Children’s Clinic with anal bruising and possible bleeding. I told him to make contact at the Children’s Clinic to receive as much information as he could about the incident, then to contact me back. Officer Steele made contact with Doctor Stratton who advised him that he saw a juvenile patient, identified as Selena Perez. Selena was presented to the Children’s Clinic by her grandmother and legal guardian, for bloody bowel movements and bleeding around Selena’s anus. Dr. Stratton stated he checked Selena and observed the bruising around her anus area and that he knows these types of findings can be indicators of child sexual abuse. Therefore, Dr. Stratton contacted the proper authorities. DHS and law enforcement arrived on scene mad contact with the child victim and her grandmother. Selena made the statement to DHS and to her grandmother that she was doing a cartwheel at school and fell while doing so, causing bruising to her anus area. On 02/11/2017 I was Dispatched to Smith Springs Elementary School for an investigation. A student Cire Kistner, was reported as being visibly distraught upon her arrival at school. She was taken to Lance Forman's office the schools principal and was questioned. The student reportedly told Forman that she and her sisters walked into the bathroom and witnessed their father, Eric Kistner, with a needle in his mouth and blood on his forehead. He was passed out on the floor. There was a spoon with "black watery play dough" on the counter. Principal Forman contacted DCS and informed them of the situation as well as MNPD. CCIB Intake received a call from Melissa Sadikoff, MSW, LCSW from Orange Coast Memorial Medical Center who informed that a report was made by the reporting party regarding 1 year old Melanie Larmarre DOB: 5/17/11. The mother of Melanie informed the reporting party she had bathed her daughter approximately 5PM. During the bath the child indicated to her mother "it stings." The mother questioned the child asking "what hurts?" The mother had noticed blood on the tissue used by the child after using the restroom. The child indicated to her mother her vagina was hurting. A report was received on 7/9/2017, indicating that Tammy Albury (mother) and Armando Guerrero (father) were involved in a domestic dispute in the presence of Cember Albury (CV-15), Devon Albury (CV-16), and Damian Guerrero (CV-1). According to the report, Armando went to Tammy’s truck to retrieve his property. It was said that Tammy went to Armando’s car to retrieve a phone cord and Armando grabbed her by the hair and pulled her by her left arm out of the car. The report indicated that Tammy fell on the ground and Armando got into his car and drove off. The report indicated that Tammy sustain a bruise on her left upper arm around the bicep. According to the report Cember (CV-15), witness Armando pulled Tammy out of the car.
Deputy Wells and I responded to a home where a 16 year old girl allegedly cut herself. When we arrived to the scene Deputy Wells’ zone partner was already on location. We entered the home together and came into contact with the kid’s mother who stated that she saw the cuts on her daughter’s wrist and determined that she had been cutting herself with a razor. When we enter the girls’ room, she was being comforted by another teenage girl, who we found out was her close friend. The victim was crying and appeared to be extremely emotional. Reporting party resident Michale Dean Lopez (DOB: 11/3/58) stated that approximately 2 months ago, that he was lying down in his bed and felt something behind him. On Tuesday, September 29, 2015, I, Officer B. McMillon, #135, of the Mansfield ISD Police Department was on assignment at Legacy High School located at 1263 N. Main in Mansfield, Texas 76063. While on the bus the week of 08/17/15, Mattie bumped her head while sitting in her sister’s lap. The child had a gash in her head that bled all over the bus. Mattie may have needed stitches but she was not taken for medical treatment. The bus driver stopped the bleeding and bandaged the child’s wounds; the driver also told Mr. Cleveland what had happened and suggested she be taken to see a doctor. It was rumored that Mr. Cleveland did not take Mattie for treatment and made statements that she would be okay. There were additional charges and consequences for others involved in the Jerry Sandusky child sexual abuse cover-up (Scolforo, 2017). The former president, Graham Spanier, was found guilty on the charge of child endangerment for his role in the cover-up. A jury decided in March 2017, due to Graham Spanier’s knowledge and position within the university he should have reported the allegation to the authorities and failed to do so. The email correspondences presented in court as evidence of his knowledge were incriminating, one email acknowledged their responsibility to report the incident (Thompson, 2017). A short time following the conviction an appeal was filed to reverse the decision or request a new trial, the appeal was denied in September 2017. The two other staff members involved, former Penn State vice president Gary Schultz and former athletic director Tim Curley, both plead guilty to the same charge earlier in 2017.
Yes, Tavion’s mother’s statement of concern about the suspicion of abuse should warrant a valid reason to lunch investigation in the child injury. Moreover, the emergency department staff had suspicion about the Tavion’s injury due to the fact injury is not consistence with an injury sustained in park playground. Hospitals are mandate by law to report any suspicion of child abuse; the Child Abuse Prevention and Treatment Act enacted in 1974 was designed to encourage the reporting of child abuse cases, and prevention. In addition, most states have enacted laws to further protect abuse children, and most states protect the individual required to report cases of suspected child abuse; the following individual are eligible to report suspected cases of abuse include healthcare administrators, physicians, interns, registered nurse, chiropractors, social service workers, psychologists, dentists, osteopaths, optometrists, podiatrists, mental health professionals, and volunteer in healthcare facilities (Pozgar, 2014).
2:10pm- IRTC called and spoke with Detective Dulanto and provided her with an update regarding this investigation. Detective Dulanto stated that Dr. Kayhill is working out of the facility close to Montefiore Hospital and it would be best for the child to go there for an x-ray. Dr. Kayhill will only be available for a few hours before she leave the facility.
Child abuse is when a parent or caregiver, through action or failure to act, causes injury, death, emotional harm or risk of serious harm to a child. According to The Federal Child Abuse Prevention and Treatment Act, as amended by the CAPTA Reauthorization Act of 2010, at a minimum, child abuse and neglect is defined as, "Any recent act or failure to act on the part of a parent or caretaker which results in death, serious physical or emotional harm, sexual abuse or exploitation"; or "An act or failure to act which presents an imminent risk of serious harm (Children 's Bureau, 2010)." The law recognizes a child as being any person who is under the age of 18. The law is broken into 2 sections, and each section treats the idea of child maltreatment in different ways. Criminally, those who abuse children are able to be arrested and prosecuted in court. Civil statutes say that people who suspect a child of being abused are mandated to identify and report it.
