Identify the type of employment relationship you would establish between the coffee shop and employees from a legal perspective. Explain your reasoning.
Cool Beans Coffee Cafe is planning on establishing an employer-employee relationship. A written agreement is going to represent our employment contract, “the terms and conditions of which represents the promises and expectations of both parties” (Heneman III, Judge, & Kammeyer-Mueller, 2012, p. 48). Short Term Surplus Plan * Reduce the amount of overtime hours available. * Temporarily make all employees part-time except for store managers. * During summer months when there are fewer students on campus shorten café hours Monday – Friday 6 am to 6 pm and Saturday – Sunday 8 am to 8pm.
Long Tem Surplus Plan * Freeze hiring and when an employee leaves do not replacement them. * Reduce workforce by laying off one store manager, one part-time and one full-time employee. * Permanent pay cut for all employees.
Outline a strategy for workforce diversity. The first workforce diversity strategy is opening recruiting to the largest demographic group possible (Heneman III et al., 2012). Since Cool Beans Coffee Café is located next to a college campus, job postings should be posted in central locations around the college campus to gain the most visibility. Also post job opening for coffee baristas at local culinary art schools because there is a wide array of ethnicities and age groups. The second workforce strategy is encouraging all employees to apply for all open promotional opportunities that they qualify for. Lastly, require all employees to interact in mandatory team building activities that promote diversity.

Currently, The Broadway Café is the only coffee shop in the area. However, recently, there have been postings that a Starbucks plans to move within the vicinity of our business. To improve the business and create a competitive advantage, we must first, research the competition through environment scanning (Baltzan & Phillips, 2007). Environmental scanning is the acquisition and analysis of events and trends in the environment external to an organization (Baltzan & Phillips, 2007). After reviewing the website of two competitors, Starbucks.com (2010) and Panera.com (2010), it appears these businesses are technologically advanced. In addition, living in Mississippi means having little to none vegetarian restaurants. Going out to eat can be a chore because I always have to plan where and what I eat. Thankfully there is a vegetarian/vegan cafe just an hour from where I live. High Noon Cafe has amazing veg friendly food and I love to recommend it to my friends and family. Besides High Noon Cafe and Whole Foods, there aren’t many other places that make me feel like I’m in vegetarian heaven. Without a cornucopia of mouthwatering vegetarian restaurants to enjoy, I mainly just cook at home. A multitude of concerns were uncovered such as lack of advancement, mentoring, coaching, networking, success planning, a positive culture regarding diversity, job training, employee empowerment, cultural bias, resistance toward diversity, uncompetitive salary, and existing work and family balance problems. After realizing these set-backs, the CEO must reconfigure the workplace around diversity, and to do so, a plan to the Board of Directors has been created and will be implemented to meet the goals of a minority and women-friendly employer, and to eventually have the two categories represent 50% of top management.
For example, the largest accumulation of IT personnel, Silicon Valley, lacks in diversity of women and minorities and is largely dominated by Caucasian males (Rodriguez, 2015). As a result, there might be a lack of diverse individuals to choose from when reaching the recruitment phase of the project. In addition, the evaluation phase of the diversity project would take the time to complete, since it assesses many aspects of the organization to gather a complete image of the issue. However, the strategic workforce planning supports the overall CML mission to provide excellent service and improve the efficiency of the organization through maximizing the workforce potential (Klingner et al., 2010).
CoffeeVille has been experiencing consistent growth in sales and numbers of customers over the last two years. This growth has led to a need for a second floor manager who is able to manage customer complaints, take responsibility for higher level café operations and manage staff performance.
The general line of reasoning is that if we learn to incorporate each other’s diverse traits and characteristics in the workplace, we can then use these differences to foster an innovative environment, which will give the company a competitive advantage over the competitors that do not accept workforce diversity. According to the Allied Academies International Conference, “Diversity is rapidly becoming a common practice among companies due to the increasing number of minorities entering the job market today. As these groups become more prevalent throughout companies, upper-level employees are facing numerous challenges when determining what changes must take place to create a positive working environment for everyone. Management is responsible for the development and implementation of effective policies directly relating to diversity to ensure the acceptance of minorities into the workplace and to aid in minorities’ success through equal opportunities and treatment.” (Marcia L. Today's workplace is more diverse than it has ever been in history. While the workforce has made strides in the direction of equality, it is still far from attaining total equality in the workplace. A company must value diversity. The main objectives of valuing diversity include awareness, education, and positive recognition of the differences among people in the workforce. Organizations are increasingly emphasizing group work or teamwork as a source of competitive advantage in a diverse workforce. It has been suggested that such organizations must target their recruitment efforts at applicants who are both diverse and amenable to working in teams ( Rau, Hyland 2003).
