The public is lack of basic legal consciousness largely because the elementary education of laws is not widespread in China (Liu, 2004). Laws govern our behavior in society and list punishments by which individuals that break them will be prosecuted and sentenced. Our criminal justice system is essential made up of three major intuitions which see a case from the beginning and through the trial and finally to the punishment phase ("How Does the Criminal Justice System Work?," 2014). Our society needs laws and punishment for those who violet the laws otherwise we would live in a world of chaos. In this paper we will examine various aspects of the criminal process from arrest through sentencing and appeal.
Tension between community interests and individual rights and freedoms are a prevalent issue within the criminal justice system. The government attempts to alleviate this tension by enacting law reform, introducing legislation and giving certain powers to judges and the police. Areas such as law lag, types of penalties, bail laws, young offenders and the police demonstrate the attempts made to relieve this conflict. The criminal justice system is a used to protect our society from those who try to harm it. Departments such as courts, and police officers study the behavior of criminals; they want our communities to be safe. When a crime is committed these departments work together to protect the rights of our society and our own. As stated in the textbook, a crime is the “Conduct in violation of the criminal laws of a state, the federal government, or a local jurisdiction for which there is no legally acceptable justification or excuse” (Schmalleger). The criminal justice system has been proven to play a very important role in society. The criminal justice system is used to keep the citizens in check and to make sure that the laws that are made are being followed. It also is there to penalize anyone who disobeys the laws. In the criminal justice system, there are 3 main parts, law enforcement, adjudication, and corrections. Law enforcement is self-explainable. It consists of the law enforcers such as police officers and sheriffs. Adjudication is made up of people in the court house such as judges and lawyers. Corrections is made up of jailhouse matters such as prison officials. In these many components of the criminal justice system, there are all put in place to help correct people to do the right thing. There are punitive efforts and rehabilitative efforts. At time, the system may lean towards one category or more, which can be dangerous in terms of disciplinary action. The criminal justice system is more punitive than rehabilitative which makes the system ineffective.
News reports daily of all of the many different crimes that has taken place. In today’s society, we depend upon the justice system. Criminal Justice is a big deal. The Criminal Justice system was put in place by the agencies and established by the governments to help control the crimes and apply penalties to those that violate the law. Crime is defined as an act or omission that the law makes punishable. There are different ways in dealing with crime. One, our current system, is the criminal justice approach. Also known as retributive justice, this system is more offender directed than anything else. The other system, which many people think is better, is the community justice, or restorative approach. Most, people disagree that there is a dichotomy between law enforcement and social workers. While an offender is on supervision there are some three main functions that Latessa and Davis talk about. Those functions are: law enforcement, social worker, and bureaucrat role. As the years have gone by and society has evolved; so have the criminal justice system and its methods to accomplish its role in society. This short analysis will evaluate the main facts that have been affecting the criminal justice system for decades and have influenced the evolution the justice system is enduring in a changing society (Muraski, 2009). Amongst the changes in the system, we will discuss the effect the changes have had on the citizens and how their perceptions have evolved as well.

Deterrence, rehabilitation, and punishment are elements that help offenders readapt back into society so they can reestablish all of the mechanisms they need to be successful. They prevent future crime, implement reconstruction, and issue consequences. They are significant and crucial factors that the criminal justice system used to promote safety, change, and justice. Deterrence focuses on future behavior by both individuals and society. As a result of offenders receiving punishment, people will deter or discourage from committing crimes in the future. The hedonistic calculus argued that harsher punishment for committing a crime will cause pain rather than pleasure and crime would be prevented (Seiter, 2017). It is basically the concept of making the punishment outweigh the reward or pleasure. I learned that they are two kinds of deterrence which are specific and general deterrence. Specific deterrence is preventing an individual offender from repeating the same crime over in the future while general deterrence focuses on society as a whole and prevent them from committing a crime in the future (Seiter, 2017).
