The space I have and the space I allow the children in my care to use. For example the children have quiet time in the front room, messy time and free play in the play room and the garden, the children do not go into the kitchen apart from to pass through to the bathroom or to observe our prepared food going into the oven. 3.1 Explain why it is important to take a balanced approach to risk management It is very important to let children asses’ danger for themselves in a secure environment. It is not good for them to be cooped up and have somebody tell them that one thing is bad and will hurt them and another will keep them safe they need to identify these things for themselves to enable them to live a positive life as an adult and to gain confidence in themselves and their own abilities. At the same time the children need to be given this chance in a safe and secure place whereby I as the carer know they will not come into any danger. 3.2 Explain the dilemma between the rights and choices of children and young people and health and safety requirements As a child care professional I am required to give each child I look after a freedom of choice and the right to choose what they would like to do or what they would like to eat or drink etc, but current legislation and requirements put a limit on what the children can choose for themselves this takes away their freedom of choice and rights in a sense as they have to have somebody dictating what will happen and what will not happen even if this is not what they would like. But children are a special case they cannot always stand up for themselves. They therefore need a special set of rights which take in to consideration their vulnerability and which ensures the adults that surround them take responsibly for their welfare, protection and development.
3.1 Explain why it is important to ensure children and young people are protected from harm within the work setting.
There is no one piece of legislation that underpins the safeguarding of children and young people in the United Kingdom but there are countless that are constantly being reviewed, changed or updated. From these many legislations, child care settings develop policies, according to the Oxford online dictionary a policy is ‘A course or principle of action adopted or proposed by an organisation or individual’.
Within my job I have a duty of care towards all of the children and young people. This is a requirement to exercise reasonable care, attention and caution to avoid negligence which would lead to the harm of others. I have to make sure that I keep these children and young people safe at all times giving extra attention towards the younger more venerable children and ensure they are safe throughout. We protect them not only from physical harm but also emotional and sexual harm. It is guarding the rights of a child as they have the right to independence and be treated with respect and dignity. This extends to respecting the rights, cultural beliefs and values of the parents and family.
It includes children’s rights to protection from abuse, their right to express their views and be listened to and the right to care and services for disabled children or children living away from home.
It is important that children and young people are allowed to exercise their rights and choices, whilst health and safety requirements are maintained. This can lead to a dilemma when children and young people wish to undertake a task that you may feel is not within their capabilities, or that is not safe for them to do so

Law and guidance are put in place for everyone to follow to ensure children’s safety and wellbeing in and outside of the work place. 1. Legislation gives a broad directive on what must be achieved regarding child protection and safeguarding. 2.
Whilst having a duty of care it is important to find the right balance between children’s rights and parent’s/carer’s responsibilities. Sometimes children’s rights may outweigh the risk. As a childminder I am there to support all children on their journey of learning and experience.

This essay will look into children becoming vulnerable and who could be responsible for failing the children. Also how government acts only come into place when big failures
Legislations and policies are extremely important in childcare settings in order to protect both staff and children. Legislations are created by a governing body and are put in place to ensure that guidelines are followed in order to reinforce safety and security within a setting. Furthermore, policies are used to ensure that everyone is working to obey the law and to meet the standards that are stated in the legislations.
