In the Declaration of Independence, it states,“whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government.” The National Collegiate Athletic Association (NCAA) is the governing body of College athletics, and is responsible for quintessentially anything even halfway near related to college athletics. It is not that the NCAA has misguided or cruel intentions, it is that it is too big of an organization to effectively work. In a New York Times story, “Emmert (NCAA President) said the N.C.A.A., college sports’ governing body, had used lobbyists to oppose the law, called the Religious Freedom Restoration Act. The law, which does not explicitly mention sexual orientation, prevents the state from forcing private individuals or corporations to do business in ways that violate religious beliefs”(Blinder) The opposition of a legally justified law expounding the first amendment right, is by no means related to sports, and is outrageous to think that taxpayers (through paying state taxes, and the state schools paying the NCAA), indirectly pay for opposition of their state governments is an egregious act. This is not the only time, where the NCAA has interjected into the political arena. It was apparent when Brian Bosworth, an Oklahoma University football player, wore a shirt on national TV coverage of the Orange Bowl declaring “National Communists Against Athletes”, with the words looking like the NCAA logo. Although this has been a battle cry for many years, in the last five years or so, it has gained national traction and become a synonymous chant with many across the nation, who desired sweeping reform. The organization was not originally designed to execute what it carries out, and needs to change, or give way to a new governing body for intercollegiate affairs. It is a political machine, that selectively prosecutes cases, and is biased on a variety of issues. It has no clear balance or accountability partner for its actions either. Student athletes face a major problem that the NCAA holds them accountable. If any student athlete commits what is held as an NCAA violation they are forced to miss playing time or other consequences as well. NCAA violations have become a chronic problem in collegiate sports. When students violate the NCAA rules it can jeopardize their future career in whatever sport they are playing. Since collegiate athletics have begun, there have been all kinds of cheating scandals involving the big-time college sports. College sports today are filled with preventable, scandalous acts made by college coaches and administrators. An example of this would be the case of fake “paper classes” at the University of North Carolina at Chapel-Hill. In addition to this, the current collegiate sport coaches are just on-site pawns that the NCAA can manipulate. The NCAA can make any rule or regulation that they would like, and if the coaches do not follow, it may just cost them their job. Finally, we look to the athletes, these individuals are truly the most influential figures in collegiate sport. These are members that can make the biggest difference when it comes to the future of university athletics. The problem with this is, student athletes do not want to risk all that they have, just to try and change some rules that they may not agree with. After the United State broke off ties with Great Britain for independence, Ben Franklin, Thomas Jefferson and other drafted the Declaration of Independence. Duncan & Juncker, (2004) write that the declaration contained words proclaimed America’s ideals of independence and freedom to all across the world. Even at the time of the writing of the Declaration, almost half a million of African Americans were slaves. Most of these slaves lived in the south, and they comprised of the 40% of the population of the South. Many colonists, including George Washington and Jefferson who opposed slavery, denouncing it as “repugnant” and “evil” and at the same time, contradicting their statements, holding a significant number of African American in their houses as slaves. The Southern colonies, being the richest in America at the time, relied entirely on slaves for their tobacco, indigo and rice plantations. They therefore were not ready to let the slaves go. The first United States government came into existence in 1781 after the adoption of the Articles of Confederation, which was silent on slavery and left the powers to regulate slavery to the individual states (Duncan & Juncker, 2004). In the past few years, there has been much talk about the unionization of collegiate sports. College athletes believe that they deserve more than just scholarships to compensate their contribution. College athletes are voicing that they should be able to form a union, and thus be paid for their athletic contributions to universities and to the NCAA. However, before one can decide whether or not unionizing collegiate sports is the right or wrong approach to solving such issues, we must first review the history of collegiate sport regulation organization and examine the pros and cons of unionization.
