Crime is often described as socially constructed, which influences our understanding of who commits a crime. Firstly, labelling theorists argue that crime is a social construction based on the powerful’s reaction to certain behaviour, those who are deviant are people that have been labelled as such. Marxists claim the bourgeoise construct crime in order to criminalise the proletariat, get away with their own deviance and maintain their own dominance. Neo-marxists look at how moral panics create a social construction of crime and can criminalise certain groups. Finally, feminists, argue crime is constructed in a patriarchal way and that the criminal justice system is harsher to female offenders. Whereas others criticise these theories for

A Few Good Men is a 1992 American legal drama directed by Rob Reiner. The story follows the court-martial of two U.S. Marines, who are charged with the murder of a fellow marine and the problems faced by the lawyers, of the accused, while preparing their defenses. The Marines are on a murder trial for carrying out a “code red” order. The movie refers to “code red” as a type of extrajudicial punishment used for an alleged crime or offense, which is carried out without a legal procedure.

It is true that criminal justice is a major part of the entertainment world. In most shows on TV today, I was really surprised when I sat down to think about what shows I watched that would actually fit in to the three components. I didn’t realize at first how many shows I watched that actually depicted the law enforcement, court systems, and the corrections aspects of Criminal Justice.

Crime is the product of the social structure; it is embedded in the very fibres of society. In this essay, I aim to explore different theories as to why crime exists within society and how we as a society therefore construct it. Crime is a social construct; it is always in society and is on the increase. It is inevitable. Where does it come from? It comes from legislation, from the making of laws.

Criminal Justice system alludes to the aggregate foundations through which a charged guilty party goes until the point when the allegations have been discarded or the evaluated discipline finished up. The Criminal Justice system comprises of three principle parts: (1) law requirement (police, sheriffs, marshals); (2) settling (courts which incorporate judges, prosecutors, resistance legal advisors); and (3) rectifications (jail authorities, post-trial supervisors, and probation officers). Today the United States of America is globally ranked nineteenth in the top one hundred countries today for their criminal justice systems. Our country's police,courts, and correction systems are one of the best in the world. Each one of these systems has special functions and parts in America’s criminal justice system.

With or without knowing it, everybody makes arguments everyday. Whether a child making a point to their mother or a lawyer making a point to the jury, everybody, sometimes unknowingly, uses methods of persuasions and classical oration to make their point seem appealing, and to get other people to agree with them. In the movie, A Few Good Men, military lawyers Lt. Jack Ross and Lt. Daniel Kaffee, like any other lawyer, must persuade and convince the jury whether the defendant is innocent or guilty. Released in 1992, A Few Good Men, presents the story of Kaffee, who is trying to defend navy officers Dawson and Downey who were accused of murdering Santiago, a fellow navy soldier. Using the term “Code Red,” Kaffee insists that Dawson and Downey were only participating in a hazing-like activity to Santiago after being ordered by their commander to toughen Santiago up. Ross, the prosecutor, states that Dawson and Downey had the intent to murder Santiago, as they killed him by shoving a poisoned rag down his throat. Although a difficult case, Lt. Kaffee makes an opening statement that is more compelling than the opening statement given by Lt. Ross by using certain methods of persuasion and a traditional approach to classical oration.

Crime has always been a shadow upon societies image, these learned behaviors can be seen in all shapes and sizes, in the cities, in the streets and even in homes. The media has controlled the image of what is perceived as crime. But what truly stalks the streets at night, is it the sadistic men who care so little about human dignity they travel from coast to coast sexually assaulting women?

It is through the Criminal Justice System’s close collaborations with like-minded agencies such as the Police, Prison and Courts Services, that the public’s concerns and worries are resolved, in order to bring about justice in our communities (Cavadino and Dignan, 2007 as cited in Fox, 2014). With that in mind and out of the way, this essay will aim to explore some of the strengths and weaknesses, which are prominent within the Criminal Justice System. To do this successfully, the Police and the Courts Service will be the key agencies that will be explored in relation to the key Models that shape the whole Criminal Justice System. These Models were founded by Herbert L. Packer (1968) and Michael King (1981).

Crime is one of those things like you said is an ever changing definition. As our culture and opinions change we see what is considered to be a criminal act and what is not. An example is marijuana, we can see how the opinion is starting to change while it is still restricted there has been a topic for debate. The media is quick to manipulate statistics and brainwash people into believing what is aired to be true. Especially crimes that are rare and not likely to happen to you.

Moreover, some argue that crime is a politically sensitive subject as well. As Treadwell James (2012, p.9) said that “The key issue about crime is power” and owing to the fact that power typically rests in the hands of politicians and businessmen they have the ability to change and bend the rules for their own good, that being so they could control what is right or wrong (Chamberlain, J.M. 2015). In addition to that Tim Newburn (2017, p.943) mentions that American sociologist Edwin Sutherland suggested that many crimes involving powerful individuals were dealt with by regulatory and civil law rather that by criminal law despite the fact that harm was done to the society. The Criminal Justice System goes as far back as the days of Jesus. There were Soldiers who acted like policeman, the tribune which was the court system, and Caesar, Herod and even Pontius Pilate stood as judge. The prison system was that of dark caves and dungeons. Crime is a socially constructed phenomenon. It is not static but dynamic and is defined into existence. It changes over time and place. For example, early definitions of crime such as classicism defined individuals as rational, free and responsible for their own actions. The emergence of positivism was an attempt to bring scientific methodology to criminology. Positivists believe in objectively quantifying cause and effect. In the early twentieth century a sociological lens was applied. Functionalist sociologists such as Durkheim argued that crime had a positive function for society by reinforcing societal norms and values (Ziyanak and Williams 2014). Anomie and strain theory proposed later by Robert Merton examined how poorer classes experienced frustration through lack of opportunities leading to strain. There are many others including labelling, control and cultural deviance, however; this shows that our understanding of criminology is not static and like crime itself it changes over time and place.

In studying crimes and deviance, sociologists look to explain what types of behavior are defined as deviant as opposed to criminal, who defines deviant behaviors, why people become deviant, and how society deals with deviant behavior. Deviance is defined by sociologists are behavior that significantly goes against expected rules and norms. Criminal behavior is behavior that violates the law. Sociology studies groups as opposed to individuals, so when studying crime and deviance, sociologists are looking at the factors that influence groups as a whole to engage in crime and deviant behavior. In defining deviant behavior, the definition may vary throughout different groups. Not all groups of people will consider the same behaviors
