In my opinion, Cole and Tisch case was a great opportunity to practice my negotiation skills. This was a case where emotions were highly involved and where the role of communication was highly important to achieve the best mutual negotiated agreement, based on mutual understating, empathy and addressing creative, “out of the box” solutions, which helped both parties to avoid from playing zero-sum game which probably will lead to court where winner takes it all , . We also focused in building our BATNA, building our approach and agenda, brainstorming over creative solutions and trying to revile the opponent’s BTNA. We agreed to invest first and decide later. Our clear mission was to avoid from having bitter confrontation and have this dispute grow worse . Our calculated BATNA was based on the concern that this case is a “Test Case” for LGAD and might lead LGAD to take the case to the court if we will not fully agree to their demands. Nevertheless, from the lawyer’s point of view, this path wasn’t so bad since he was sure that we will win the case (a reminder that both sides sometimes sure that they will win the case in court , but we were more concerned about the optional public release of the mayor’s memo. Our BATNA was wining in court which will lead to make no changes in the policy and probably will prevent any future conflicts with LGAD, but in looking on the worst case scenario, we assumed that LGAD team are aware of the potential impact of releasing the memo in public and plan use it as a strong barging tool. Therefore, shifting the case to a discussion in court wasn’t ideal solution, a fact that made us agree that we have more to lose in court than LGAD. In terms of power, we understood that LGAD will have the power to say "no" and lead the case into court. On the other end, DHS had last power because our BATNA was weaker than LGAD's BATNA . Gina Blair and Daniel Trent cooperate and collaborate to achieve a common objective throughout their negotiation. A cooperative negotiation style is demonstrated as they combine their points of view regarding their clients concerns with outcomes to effectively solve the issues raised. The main focus of the negotiation is to reach an agreement rather than a continuous dispute. Accordingly, the conflicting objectives were resolved by compromises and solutions but forward by both Gina and Daniel. The negotiation style used between Gina and Daniel is described as principled negotiation where both parties jointly attack the problems arising to achieve a compromise.
I invested a significant amount of time to prepare for the Byrnes, Byrnes & Townsend negotiation meeting. I represented Mrs. Townsend, the plaintiff in this case and I chose co-operative strategies and tactics for this negotiation exercise. For me to address the liability and evaluate the case, I had to divide the facts in four categories: weaknesses and strengths of the opponent, weaknesses and strengths of my case. From the class discussions, I learned that the success of the negotiation directly depends on the preparation stage, therefore, I carefully assessed the obtained information, evaluated interests of both parties, set out substantive, intangible, and procedural goals, developed mine and my opponent`s BATNA, set the limits, and implemented negotiation strategy and tactics.
Fontaine's or Gaudin's had good bargaining techniques. In my opinion these employees did not have enough time on the job, experience or in the business Their preparation for negotiations with Relient was inadequate. Adequate preparation should include careful study of strengths and weakness of both side along with the study of the need of the other party and ways to satisfy those needs. In our recent negotiation, my partner Dave and I assumed the roles of Alan Hacker, a computer software developer, and Alan Hacker’s lawyer. Being the lawyer in the negotiation my objective was to avoid litigation with my client’s partner Stanley Star and to aid in the continuation of my client’s co-owned company HackerStar. Having analyzed the scoring scheme and weights given to each outcome, I realized that the most important outcome was obtaining a large federal loan from the government. In fact, obtaining a $2 billion loan outcome alone would satisfy the governor’s scoring scheme to support the project. Therefore, before going into the negotiation I realized that this issue would be a pivotal outcome in the negotiation for me. If I succeed in negotiating the right federal loan amount I could be flexible with the other issues in the negotiation but keeping in mind that the higher the score the better the result for the governor. My BATNA was to walk away from the deal where I would still maintain the 30 points in that situation which meant that if the result of the outcome was less than 30 points, I would vote against the deal.

Both our approaches were directed towards addressing the issues with a collaborative spirit for the greatest benefit to both sides. We agreed that both sides wanted to establish a long term a relationship with each other and were willing to give genuine consideration to each other’s particular needs and interests. This experience has enabled me to reflect on my personal approach towards negotiation, as well as analyze my strengths and potential areas for improvement as a negotiator.
Although the parties in this case all have respective BATNAs, none are very good and would lead to a “lose-lose” proposition. For example, Mouse could disregard the positions and interests of the Mayors and attempt to move forward with the project. However, this would lead to risks such as project delays, increases in budget, lost revenue and diminished reputation in other foreign countries. Also, it would lead to a bad public relations image for the company. Therefore, the Mouse BATNA is very weak and it is in their best interest to find and agreement that satisfies all parties.
