In my opinion, Cole and Tisch case was a great opportunity to practice my negotiation skills. This was a case where emotions were highly involved and where the role of communication was highly important to achieve the best mutual negotiated agreement, based on mutual understating, empathy and addressing creative, “out of the box” solutions, which helped both parties to avoid from playing zero-sum game which probably will lead to court where winner takes it all , . We also focused in building our BATNA, building our approach and agenda, brainstorming over creative solutions and trying to revile the opponent’s BTNA. We agreed to invest first and decide later. Our clear mission was to avoid from having bitter confrontation and have this dispute grow worse . Our calculated BATNA was based on the concern that this case is a “Test Case” for LGAD and might lead LGAD to take the case to the court if we will not fully agree to their demands. Nevertheless, from the lawyer’s point of view, this path wasn’t so bad since he was sure that we will win the case (a reminder that both sides sometimes sure that they will win the case in court , but we were more concerned about the optional public release of the mayor’s memo. Our BATNA was wining in court which will lead to make no changes in the policy and probably will prevent any future conflicts with LGAD, but in looking on the worst case scenario, we assumed that LGAD team are aware of the potential impact of releasing the memo in public and plan use it as a strong barging tool. Therefore, shifting the case to a discussion in court wasn’t ideal solution, a fact that made us agree that we have more to lose in court than LGAD. In terms of power, we understood that LGAD will have the power to say "no" and lead the case into court. On the other end, DHS had last power because our BATNA was weaker than LGAD's BATNA . Therefore, we focused on systematic preparation and carful strategy
