Since the music industry is quite diverse it is consequently impacted by a great number of ethical issues. The issues span across the production side to the consumptions side of music. They issues deal with things as inconsequential as lip syncing to the breaking of laws when stealing music. Although there are a lot of different areas that can be examined within the industry, the most important ethical issues fall under the category of compensation.
The first major aspect of compensation is in regard to royalties. Royalties are defined as “an amount of money that is paid to the original creator of a product, book, or piece of music based on how many copies have been sold” according to Webster’s dictionary. Artists

The question then became “Just because we can get the music we want without paying for it, should we?” (Tyson, 2000, p.1). This issue of illegal downloads, which is also referred to as piracy, has been a hot topic ever since the introduction of Napster. According to Recording Industry Association of America “In the decade since peer-to-peer (p2p) file-sharing site Napster emerged in 1999, music sales in the U.S. have dropped 47 percent, from $14.6 billion to $7.7 billion” (RIAA, 2014).
When people illegally download music they are robbing the artists of royalties. The fact that people are increasingly stealing music begs a further question of how slippery this slope is. Will the music industry stop making money altogether because people can just find a way to get their music illegally? While this is the far extreme it is important to note the far reaching implications of what this could mean for the industry. Striking losses of profits would cripple artists and everyone involved in producing or distributed the music. An example of how the music industry is losing profits on royalties is evident with the declining us of CDs. Today, the CD is becoming an outdated and inferior product that only true fans of an artist will seek out. Another example is when music is being purchased legally online. When consumers purchase online music it is almost always going to be a lower cost. As a consumer, you have the option to just buy the songs you like.
According to the Recording Industry Association of America (RIAA), 30 billion songs were illegally downloaded between 2004 and 2009. Even with sites like iTunes and Rhapsody offering legal downloads, peer-to-peer file sharing still exists. Illegally downloading music has had a significant impact on the music industry resulting in a loss of profits and jobs, and changing how music is delivered to the masses. (Adkins, n.d.) After the period elapses, any person can use, print, publish, and distribute the original work. The music industry has been in dispute for many years in respect to music piracy. It went after software and website developers, as well as consumers in the courts (Easley, 2005, p.163). As a result, this may be why governing the expansion of the music industry towards later benefits for the industry; however, not toward those who pirate from them (Easley, 2005, p.163). There is clear evidence of a willingness to pay for online music in general through legal download services such as iTunes (Easley, 2005, p.163). It is clear that some new markets are emerging; for example, services such as 4G LTE combine music with other services. These markets may provide both better margins and better copyright protection to the music industry. Nevertheless, some forms of music piracy may ultimately come to be seen as an effective marketing channel for those services (Easley, 2005, p.163). Clearly the industry is adapting piracy issues.
Music has become a center piece of life; however it comes with a vigorous price unknown to most of the public. The music industry is littered with corruption. My proposed research problem focuses on the manipulation and control the music industry has upon its artists through an unescapable 360 deal, which in and of itself is not only reducing an artist to almost indentured servitude, but also cripples record labels themselves. The 360 deal is a common mandatory contract record labels utilize to financially support an artist. This includes advances and funds for promotion, touring, and marketing, all which the artist has to pay back to the label. I believe this problem is significant and warrants further research because the record labels are unconstitutionally taking away artists rights in favor of their own greed, in turn, leaving the artist without ownership of their own songs, money, and rights to royalties.
When thinking about music downloading and streaming we must not only consider legal mediums (which only exist because the practice was illegal after Napster’s failure) such as iTunes and Spotify, we must consider the overwhelming presence of illegitimate or illegal streams and downloading mediums such as FrostWire or YouTube2MP3. The music industry revenue streams have been changed, molded, and affected by the music downloading and streaming world in many ways. The music industry makes money through three ways: album/single sales, royalties, and concert revenues. All three of those streams have been effected in various ways some negative and some positive. Digital piracy on music has been a majorly disputed affair for the last eighteen years, about whether or not it favors the musical artists or affects them in a negative fashion. One of the many sides of the Digital piracy controversy expounds that it benefits the artist(s) by giving them a great deal of exposure that they may not have received had they not downloaded it for free, which in turn makes for a very significant acquisition in terms of sales on their part.
Music and concerts are an everyday occurrence for people. Changes through the generations of the music industry has become more complicated and confusing. To defy these issues certain organizations were created to help songwriters, composers, and music publishers. Well known organizations such as Broadcast Music Inc. and The American Society of Composers, Authors, and Publishers help people in these positions with legality and protection of their music publicly.
A lot of us love music and in this day and age it can be hard to come by, especially if you don’t have anyway to buy online. The sound of music can affect all of us and our emotions. Now, anyone with talent can post a video of themselves and become an internet sensation, only to then receive a deal with a label to continue growing their career. The issue is, with the Internet came digital downloading, and with the growing popularity of digital downloading came illegal downloading, known as Digital Piracy, which has affected the music industry greatly. This issue affects everyone involved in the Music Industry. From the small CD store owner to the Artist on stage, everyone has and continues to be affected by the growing popularity of digital downloading services. Artists, producers, and songwriters lose an estimated 12.5 Billion USD every year to illegal digital music services. Further, the economic impact from [digital downloading] is an estimated loss of 2+ Billion USD (Storrs, 1). This money affects the “little guys” in the industry and the average worker within the industry.
In 1950, the international Federal Phonographic Industry, European Broadcasting Union and the International Federation of Musicians represented the three interests. These finally gave birth to the Rome Convention. Copyright is protected in different Articles of the Convention. Just to highlight one of them, Article 7 provides that performers are to be given rights that prevent broadcasters from communicating the information to the public. This is congruent with the ethical requirements of sharing music. It also prevents performance, fixation and reproduction without their consent. These provisions, among others, apply to music recordings and performances in Canada by being a member of the convention. In most cases, we find that ethical expectation in the way music is shared in Canada is also provided in statutes, boards, and treaties. With this, the ethical channels needed in sharing music may not have been expressed by are implied in the underlying legalities (Freeman, 2015). The music industry much like every other industry has found ways to connect their product to the people through technology. Now music is readily available to the public through many avenues ITunes, YouTube, and so much more. As music has become more available to the public the industry now faces the threat of illegal downloading and sharing of music files. Many people will purchase an album through a download site and then either post it for free download to others or distribute it to their friends; while those who do this don’t usually face consequence does that make it right?
Illegal music downloads have caused a massive fall in the sales and income of the labels and artists, which has been driving them to bankruptcy quicker. Companies like Apple, have decided that it is best to get in with the downloading business. However, an end to the illegal downloading conflict remains to be realized. The RIAA and associated artists continue to wage war against illegal downloaders while computer savvy audiences persist in sharing music files online every day. While it is undoubtedly true that downloading music is a crime, it remains to be proven that it is wrong. Without establishing this principle, most downloader's are likely to continue the activity. Even with new, inexpensive and available means of downloading files, they can still be shared for free online. The rift must be repaired between music lovers who feel that they have been taken advantage of in the past and recording companies and artists who worry about their future livelihood.
